REPUBLIC ACT No.

9155
-Be enacted by the Senate and House of
Representative of the Philippines in Congress
SECTION 1. Short Title:
- “Governance of Basic Education Act of 2001”
SECTION 2. Declaration of Policy:
 STATE
-To protect and promote right to qualify basic
education and make such education accessible
to all. Such education shall also include
ALTERNATIVE LEARNING SYSTEMS for basic
education.
 SCHOOL
- Shall be the heart of the formal education system.
 GOVERNANCE OF BASIC EDUCATION
-Shall begin at the national level. It is at the field
offices (Regions, divisions, schools and learning
centers).

The State shall encourage local initiatives for


improving the quality of basic education. Schools
and learning centers shall be empowered to make
decisions on what is best for learners they serve.
 SECTION 3. Purposes and Objectives

- Provide the framework for the governance of


basic education and provide resources.
- Define roles and regulations.
- Make schools and learning centers the most
important vehicle for teaching-learning of
national values and reflect it. They also receive
focused attention they deserve by encouraging
local initiatives.
 SECTION 4. Definition of Terms
a. ALS- is a parallel learning system.
b. BASIC EDUCATION- is the education intended
to meet basic learning needs.
c. CLUSTER OF SCHOOLS- is a group of schools
which are geographically contiguous.
d. FORMAL EDUCATION- is the systematic
process of hierarchically structured and
sequential learning.
e. INFORMAL EDUCATION- is a lifelong process
of learning.
f. INTEGRATED SCHOOL- is a school that offers a
complete basic education in one school site.
g. LEARNER- is any individual seeking basic
literacy skills and functional life skills.
h. LEARNING CENTER- is a physical space to
house learning resources and facilities
i. LEARNING FACILITATOR- is a key-learning
support person.
j. NON- FORMAL EDUCATION- is any organized,
systematized educational activity carried outside
the framework of the formal system.
k. QUALITY EDUCATION- is the appropriateness, relevance and excellence of the education.

l. SCHOOL- is an educational institution (Public


and Private), undertaking educational operation.
m. SCHOOL HEAD- is a person responsible for
the administrative and instructional supervision
of the school or cluster of schools.
Chapter 1. Governance of Basic Educ.
 SECTION 5. Principles of Shared Governance
-A principle which recognize that every unit in
education bureaucracy has a particular role
-The process of democratic consultation shall be
observed in the decision-making process at
appropriate levels. Feedback mechanism shall
be established to ensure coordination and open
communication of the central office.
-The principles of accountability and
transparency shall be operationalized by the
performance of functions at all levels; and
- The communication channels of field offices
shall be strengthen to facilitate of
information and expand linkages
 SECTION 6. Governance
- The Dept. of Education, Culture and Sports
shall be called the Dept. of Education.
 SECTION 7. Powers, Duties and Functions
- The Secretary of the Dept. of Education shall
exercise overall authority and supervision over
the operation of the Department.
A. NATIONAL LEVEL:
- They formulate national educational policies
and basic educational plans. They also
promulgate national educational standards by
monitoring and assessing national learning
outcomes also by undertaking national
educational research and studies. Enhancing
the total development of learners, employment
status and etc. are also under their authority.
The Secretary of Educ. Shall be assisted by not
more than 4 assistant and undersecretaries.
B. REGIONAL LEVEL:
Each regional offices shall have a director, an
assistant officer and an office staff.
- They define a regional educational policy
framework by developing a regional basic
educational plan and standards of the divisions
and districts especially dealing with budgets and
the organization component. They monitor/assess
regional learning outcomes by undertaking
regional projects and evaluate all employees in
the regional office including the assistant and
division superintendents except for the assistant
director.
C. DIVISION LEVEL:
A division shall consist of province/city with
a schools division superintendent of at least 1
assistant and an office staff.
- They implement division educational
development plan which includes planning
efficient use of all personnel and evaluating all
division and school district supervisors,
employees in the district including school heads
except for assistant division superintendent. They
monitor funds and compliance of quality and
accreditation standards for basic education by
supervising the operation.
D. SCHOOL DISTRICT LEVEL:

A school district shall have a school district


supervisor and an office staff .
- They provide professional and instructional
advice and support to the school heads and
teachers of schools and learning centers in the
district cluster thereof; curricula supervision and
performing such other functions as may be
assigned by the proper authorities.
E. SCHOOL LEVEL:
There shall be a school head and may be
assisted by an assistant school head for all public
elementary & high schools that are both
instructional leader and administrative manager.
A core of non-teaching staff shall handle the
school’s administrative and auxiliary services.
- They set the mission, vision, goals and
objectives and to create an environment within
the school. They implement the school
curriculum, basic program, improvement plan
and introduce new and innovative modes of
instruction to administer all personnel and
Chapter 2. Transfer of Cultural Agencies
 SECTION 8. Cultural Agencies
- The Komisyon ng Wikang Pilipino, National
Historical Institute, Records Management and
Archieves Office and National Library shall be
administratively attached to the National
Commission for Culture and the Arts (NCCA) and
no longer with the Dept. of Education. The
program for school art and culture shall remain
part of the school curriculum.
Chapter 3. Abolition of the Bureau of
Physical Education and School Sports
 SECTION 9. Abolition of BPESS
All functions, programs and activities of
the Dept. of Education related to Sports
Competition shall be transferred to the
Philippine Sports Commission (PSC). The
program for school sports and physical fitness
shall remain part of the basic education
curriculum. The Bureau of Physical Education
and School Sports (BPESS) is hereby abolished.
Chapter 4. Support and Assistance of the
Other Government Agencies
 SECTION 10.
- The Secretary of Education and the Secretary
of Budget and Management shall within 90 days
from the approval of this Act jointly promulgate
the guidelines on the allocation, distribution and
utilization of resources provided by the national
government for the field offices and the working
condition of teaching services.
 SECTION 11
- The Secretary of the Dept. of Education,
subject to civil service laws and regulations,
shall issue appropriate personnel policy.
 SECTION 12.
- The Commission on Audit, in the issuance
of audit rules and regulations that will govern
the utilization resources ( liquidation, records
and reports), shall take into account the
different characteristics and district features of
the department’s field offices.
Chapter 5. Final Provision
 SECTION 13. Governance in the ARMM
- The Regional Secretary for the Autonomous
Region in Muslim Mindanao (ARMM) shall
exercise similar governance authority over the
divisions, districts, schools and learning centers
in the region as may be provided in the Organic
Act without prejudice to the provisions of
Republic Act No. 9054.
 SECTION 14. Rules and Regulations
- The Secretary of Education shall promulgate
the implanting rules and regulations within
90 days after the approval of this Act.
Provided, that, the Secretary of Education
shall fully implement the principle of shared
governance within 2 years after the approval
of this Act.
 SECTION 15. Separability Clause
 SECTION 16. Repealing Clause
 SECTION 17. Effectivity Clause
- This Act shall take effect 15 days following its
publication in at least 2 newspapers of general
circulations.

This Act which is consolidation of House Bill No.
10732 and Senate Bill No. 2191 was finally passed by
the house of representatives and Senate on June 6,
2001 and June 7, 2001, respectively.
