The argument of the book, using philosophical and literary, as well as halakhic methods, is the search for a halakhic solution to the problem of the agunah which respects this principle. Two chapters are devoted to "Making Decisions - Desiring. Intending, Wanting and Willing - from ratson to da'at" and "Growing up for Good: from da'at to radical autonomy", and these concepts are then applied to the issues of conditional marriage, annulment and coercion.

It includes a statistical analysis of the incidence of these two maxims in 45 pisqei din available from the Responsa project. An initial chapter describes the halakhic context in which these maxims are encountered. The book concludes with a chapter on th necessity for proof, and on a summary of the influence exerted by these two maxims,
