RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY OF
OAKLAND AND THE EAST BAY ZOOLOGICAL SOCIETY FOR THE
PROVISION OF DESIGN, CONSTRUCTION AND PROJECT MANAGEMENT
SERVICES FOR IMPROVEMENTS TO THE OAKLAND ZOO IN THE AMOUNT
NOT TO EXCEED FIVE MILLION ONE HUNDRED NINETY THOUSAND
DOLLARS ($5,190,000).
SUMMARY
Measure K authorized $60 million in general obligation bonds for the acquisition of open space
land ($23.6 million), development of parks and recreational projects ($26.4 million) and Oakland
Zoo development projects ($10 million). Exhibit A lists Measure K legislated projects
completed, underway, and to be done in Series 2000D. Council is obligated to use Measure K
funds to satisfy the legislated projects before considering alternative uses for the bond proceeds
and interest earnings. To date, Council has authorized spending a total of $49.35 million in three
consecutive series, Series 1991A, Series 1994B, and Series 1997C.
A total of $10.65 million remains for the final series, Series 2000D funded on June 13, 2000
(Resolution 75791 C.M.S.). Of the $10.65 million, $4.545 million is currently obligated for
open space acquisitions, $635,000 for park development proj ects, and $5. 19 million for Oakland
Zoo projects.
The City Council is requested to approve a resolution authorizing the City of Oakland to enter
into a master agreement with the East Bay Zoological Society for the provision of design,
construction and project management services for Measure K Series 2000D projects at the
Oakland Zoo in the amount of five million one hundred ninety thousand dollars ($5,190,000).
FISCAL IMPACTS
The funding allocation for this project was approved by the City Council on March 28, 2000 by
Resolution 75791 C.M.S.. Funds are available in the Measure K Series 2000D to pay for these
services. The proposed resolution, for a total contract not to exceed five million one hundred
ninety thousand dollars ($5,190,000) would allow for the completion of a variety of animal
exhibits, facility and landscape improvements and incorporation of additional public art at the
Oakland Zoo. No General Fund monies have been appropriated in connection with Measure K
funding.

Oakland voters approved Measure K on November 6, 1990 to provide $60 million for open space
acquisitions and park development projects. Measure K obligates the City to provide $23.6
million in open space acquisitions, $26.4 million in park and recreation development projects,
and $10 million in Oakland Zoo development projects.
Measure K spending is separated into sequential funding series in order to provide adequate time
for completing community involvement, design and construction phases. Council has authorized
four funding series to date. Series 1991A was authorized for $12 million, Series 1994B was
authorized for $15.1 million, Series 1997C was authorized for $22.25 million and the fourth and
final series of Measure K, Series 2000D, was issued in July 2000 for $10.65 million.
KEY ISSUES AND IMPACTS
The approved Measure K Series 2000D program allocated bond proceeds to four development
projects, one which is proposed to be implemented by a specified non-profit organization, the
East Bay Zoological Society. The approach of using community organizations, rather than City
staff, to complete capital improvement project work for various projects funded with Measure K
monies was initiated during Measure K Series 1991A program. The Oakland Zoo has previously
completed capital improvement projects for Measure K Series 1991A, 1994B, 1997C and
Measure I 1997. As a Result, the East Bay Zoological Society has a background of working with
City regulations and compliance programs regarding prevailing wages, meeting public art, bid
requirements, contractual obligations, and Measure K covenant provisions.
The remaining three Measure K Series 2000D development projects, Temescal Pool
Improvements construction ($495,000), Peralta Hacienda Historical Park -Phase III ($280,000)
and Trail Improvements ($160,000) are scheduled to be managed by City staff.
Parks and Recreation Advisory Commission: At their regular meeting on February 9, 2000 the
Parks and Recreation Advisory Commission (PRAC) reviewed and approved the list of Measure
K Series 2000D projects proposed for management by non-profit organizations.
Measure K Procedural Manual: The Measure K Procedural Manual, which was developed to
assist community organizations in the implementation of this program, requires that the City
Council approve a master agreement between the City and each community organization in order
to provide the legal framework under which Measure K monies can be distributed to the
responsible group, allowing them to complete work on designated projects. The Series 2000D
master agreement between the City and the East Bay Zoological Society is now being submitted
for review and approval.
Master Agreement General Conditions
The East Bay Zoological Society is required to complete all associated project work including
filing notices of completion and conducting final fiscal reviews by June 30, 2003. The East Bay
Zoological Society is also required to assure that appropriate insurance, employment and Public

Works compliance issues are addressed as a part of determining successful performance. Staff
from the Life Enrichment Agency, Public Works Agency, and the Community and Economic
Development Agency work together with each of the involved groups to assure that all City
requirements are met.
Project Description and Master Agreement Details
Oakland Zoo Improvements
The $10 million funding allocation for the Oakland Zoo was specified in the voter information
distributed for Measure K approval. The Oakland Zoo received $1 million in Series 1991A
monies, $2.03 million in Series 1994B monies, and $1. 78 million in Series 1997C. Distribution
of $5.19 million in Series 2000D will fulfill the original grant.
The East Bay Zoological Society, which is the agent of record for this project, plans to use its
$5.19 million Measure K Series 2000D allocation to improve various animals exhibits including
renovations to the elephant, tiger, giraffe, camel, squirrel monkey, and wallaroo exhibits; minor
renovations to several small animal exhibits; landscape improvements including restoration of
Arroyo Viejo Creek; facility improvements including park entrance renovation, children's zoo,
introduction of new signage, Environmental Education Center additions, new restrooms to serve
the lower park, upgraded children's playground, Children's Ride Area additions and renovations,
Snow Building renovations and ADA upgrades to ride area restrooms; and development of
concept plans for the California 1820 native animal and plant region. Concept plans will include
development of the general theme, animal exhibit layout survey, visitor circulation, general
landscape, civil engineering, visitor service and interpretive program needs.
ENVIRONMENTAL OPPORTUNITIES
Measure K Series 2000D projects at the Oakland Zoo will incorporate various environmental
opportunities in the scope of work for various projects. Opportunities include reduction of
development impact on certain ecosystems through the acquisition of open space, promotion of
water and energy conservation through the selection of appropriate equipment and fixtures,
reduction of vehicular air pollution by providing pedestrian and bicycle trails, and promotion of
environmental goals by providing an educational amenity at the Arroyo Viejo Creek.
DISABILITY AND SENIOR CITIZEN ACCESS
All projects will be designed and constructed to be ADA and senior citizen accessible. The
City's accessibility program coordinator will be requested to participate in project review at
various stages of each design process initiated.
RECOMMENDATION(S) AND RATIONALE
Staff recommends that City Council accept this report and approve a resolution authorizing the
City of Oakland to enter into a master agreement with the East Bay Zoological Society for an
amount not to exceed five million one hundred ninety thousand dollars ($5,190,000) in Measure

K Series 2000D bond monies for the design, construction and project management services for
improvements to the Oakland Zoo.
Implementation of the identified capital improvements will enhance the quality of the Oakland
Zoo, allow the Zoo to compete with other entertainment venues and provide an accessible and
modern facility and community resource.
ACTION REQUESTED OF THE CITY COUNCIL
That the City Council approve a resolution authorizing the City of Oakland to enter into a master
agreement with the East Bay Zoological Society for the provision of design, construction, and
project management services for Measure K Series 2000D projects in the amount of five million
one hundred ninety thousand dollars ($5,190,000).

THE EAST BAY ZOOLOGICAL SOCIETY IN AN AMOUNT NOT TO EXCEED FIVE MILLION, ONE
HUNDRED NINETY THOUSAND DOLLARS ($5,190,000) IN MEASURE K SERlES 2000D BOND
MONIES FOR THE PROVISION OF DESIGN, CONSTRUCTION AND PROJECT MMANAGEMENT
SERVICES FOR VARlOUS PROJECTS AT THE OAKLAND ZOO
WHEREAS, On November 6, 1990, the voters of the City of Oakland approved the Measure K
general obligation measure for the purpose of acquiring and developing municipal park, recreation, and open
space facilities; and
WHEREAS, passage of said bond measure authorized the City to sell general obligation bonds in
consecutive series for a total of $60 million; and
WHEREAS, THE City wishes to retain the services of the East Bay Zoological society, a California
charitable non-profit organization to administer and procure professional services providers and construction
contractors to install various improvements; and
WHEREAS, the City Council finds that the services under the contract will be temporary; and
WHEREAS, Council finds that this contract shall not result in the loss of employment or salary by
any person having permanent status in the competitive service; now therefore, be it,
WHEREAS, the East Bay Zoological Society is qualified to perform said services and expects to have
completed work on these projects by June 30, 2003; now therefore, be it
RESOLVED: That the Oakland City Council hereby authorizes a master agreement between the City
of Oakland and the East Bay Zoological society for the period from July 1, 2000 through June 30, 2003, and
appropriates to the East Bay Zoological Society, an amount not to exceed five million, one hundred ninety
thousand dollars ($5,190,000) in Measure K Series 2oo0Dbond monies for the installation of various projects
at the Oakland Zoo; and be it
FURTHER RESOLVED: That the City Council hereby appoints the City Manager of his designee as
agent of the City to conduct all negotiations, execute and submit all modifications, payment requests, and related
actions which may be necessary for the completion of the aforementioned agreements in accordance with their
specified purposes provided that such amendments or extensions shall be filed with the City Clerk's Office: and
be it
FURTHER RESOLVED: That the City Council directs the City Manager, or his designee, to impose
all applicable SLBE/LEP and living wage requirements into such agreement; and be it
FURTHER RESOLVED: That the Office of the City Attorney shall approve the agreement as to fonn
and legality and a copy shall be filed at the Office of the City Clerk.
