Prospective bidders should have experience in undertaking a similar project within the

Last two (2) years with an amount of at least 50% of the proposed project for bidding. The Eligibility

Check/Screening as well as the Preliminary examination of Bids shall use non discretionary “pass/

Fail” criteria. Post-qualification of the lowest calculated bid shall be conducted.

All particulars relative to eligibility Statement and Screening, Bid Security, Performance

Security, Pre-Bidding Conference (s), evaluation of Bids, Post Qualification and award of contract

Shall be governed by the pertinent provisions of R.A. 9184 and its Implementing Rules and

Regulation (IRR).

INSTRUCTION TO BIDDERS

Sealed proposals plainly marked, Re-bidding for the ___________________________________


Will be received at the Office of BAC until ___________________________________________ and then
Publicly opened by the Bids and Awards Committee in the presence of the participating bidders on
____________ at _________.

CONDITIONS:
1. That the bidders shall through their authorized officer or their duly authorized
representative following documents to the BAC;
a. DtI business name registration or SEC registration certificate, while ever may be
appropriate under existing laws of the Philippines,
b. Valid and Current Mayor’s permit/mun. License, if applicable.
c. Taxpayer’s Identification Number;
d. Statement of the prospective bidder that is not “blacklisted” or barred from bidding by
the government of any of its agencies, offices, corporations or LGUS including non-
inclusion in the Consolidated Blacklisted Report issues by the GPPB as provided in sec.
694 of this IRR-A
e. Other appropriate licenses as may be required by the procuring entity concerned;
f. The perspective bidder’s audited financial statement;
g. Credit line from licensed bank or certificate of cash deposit;
h. Letter authorizing the BAC to verify any or all submitted documents;
i. Certificate of the bidders under oath its compliance with existing labor laws and
standards ( if applicable) ;
j. A sworn affidavit that the bidder is not related to the head of the procuring entity by
consanguinity or affinity up to the third civil degree.
2. That the bidder shall state in his whether he Is domestic or foreign entity defined in the
Commonwealth Act No. 138;
3. The required minimum bid security shall be based on the schedule states below and be
indicated in Philippine Peso in the bidding documents;

1) Cash, certified check, cashier‘s check, - One percent (1%)
Manager’s check, bank draft or irrevocable
Letter of credit
2) Bank guarantee - One and a half percent ( 11/2%)
3) Surety Bond - two and a half percent (21/2%)
4) Foreign government guarantee - One hundred percent (100%)
4. Bids received without the required deposit will be rejected.
5. That the delivery of the materials shall be complete within fifteen (15) working days upon
receipt of the contract duly acknowledge.
6. It is understood that the time essential factor of the contract to be drawn and that the
failure of contractor to finish the delivery within the time stipulated, the contractor shall be
liable to indemnity the government in the sum Five Hundred Pesos (p500.00) Philippine
currency, for each day of delay as liquidated damages, except due to “Force Majoure” for
obvious reasons.
7. The right is reserved to reject any or all bids, to waive any defect therein or to accept such
bids as may be considered most advantageous to the government.
8. That this Instruction to bidders be posted in a conspicuous space.
9. That the Office of the BAC of this Barangay will provide a copy of Invitation to bid to any
prospective bidders and they will be recorded to a Memorandum Book.
10. Bidders must follow strictly the call for the bids specified. No. bidders shall be allowed to
change or alter his bid during the time of bidding.
