AFFIDAVIT
I, EDGAR V. CAÑETE, of legal age, Filipino and a resident of Ormoc City, Leyte,
Philippines, after having been duly sworn to in accordance with law, hereby depose and
state, that:
1. That I am the sole heir of the late AURORA V. CAÑETE who is the true and
registered owner of a certain parcel of land which is covered by Transfer Certificate of
Title No.4047, more particularly described as follows:
“A parcel of land (Lot No. 3259) of the Cadastral Survey of Ormoc) situated in the
Barrio of Patag, Municipality of Ormoc. Bounded on the NE., by Lots Nos. 3285
and 3287 on the S. by Lot Nos. 3285,3286,3258,3256 and Salvago Zone of the
Panali-an River; on the SW., by Lots Nos. 3255,3260,3261,and 3263; and on the
NW., by Lots Nos. 3264,3266 and 3470xxxxxxcontaining and area of Ninety Seven
Thousand Two Hundred Sixty Seven (97,267) square meters more or less.”
2. That annotated on said Transfer Certificate of Title No. 4047 is a Contract of

Lease more particularly described as follows;
Entry No. 3957-Contract of Lease in favor of Roy Bernard C. Fiel-Executed by

Aurora V. Cañete- Conditio; That the (5) hectares of the parcel of land described
in the certificate of title has a contract of lease for (3) sugar crop year, from
2008-2009-2010and 2010-2011 for P 3,500per hectare, other condition set forth
in Doc. No.: 117; Page No.: 24; Book No.:CXl; Series of 2006 of Notary Public of
Ormoc City. Nicolas S. Maglasang.
3.That the effectively and efficacy of said entries have since expired as shown by
the dates thereon and/or were correspondingly superseded by other entries which are
also being caused to be cancelled in view of the fact that the party to said annotation
has registered no opposition to its cancellation.
4.That I am executing this affidavit purposely requesting the Register of Deeds to

cause the cancellation of the above-mentioned entries in the aforementioned Transfer
Certificate of Title.

Philippines, after having been duly sworn to in accordance with law, hereby depose and
state, that:
1. That I am the lessee of a certain parcel of land owned by the late AURORA V.
CAÑETE who is the true and registered owner of a certain parcel of land which is
covered by Transfer Certificate of Title No.4047, more particularly described as follows:
“A parcel of land (Lot No. 3259) of the Cadastral Survey of Ormoc) situated in the
Barrio of Patag, Municipality of Ormoc. Bounded on the NE., by Lots Nos. 3285
and 3287 on the S. by Lot Nos. 3285,3286,3258,3256 and Salvago Zone of the
Panali-an River; on the SW., by Lots Nos. 3255,3260,3261,and 3263; and on the
NW., by Lots Nos. 3264,3266 and 3470xxxxxxcontaining and area of Ninety Seven
