Initial Draft (CONTRACT OF LEASE)
This is a contract to lease, made and executed in Baguio City, Philippines, on this 1st day of
February 2020 by and between;
Spouses Thomas and Emma Lomas-e, of legal age, Filipino and residents of 163 Purok 7,
Camp 7, Baguio City, Philippines, herein after known as the LESSORS;
And
Mr. Tom Christian N. Lomas-e, of legal age, Filipino and a resident of 163 Purok 7, Camp
7, Baguio City, Philippines, herein known as the LESSEE.
WITNESSETH THAT
WHEREAS, the LESSEE desires to rent the building and the LESSORS are agreeable to give
same to the LESSEE by way of lease;
NOWTHEREFORE, LESSORS by these presents shall hereby cede and deliver possession
unto the LESSEE by way of lease the above mentioned building and the LESSEE hereby
accepts the same subject to the following terms and conditions to wit:
1. The term of this lease shall be for a period of Three (3) year counted from the date of
execution of this contract;
2. The LESSEE shall pay unto the LESSORS the sum of THIRTY FIVE THOUSAND
PESOS (P35,000.00) as monthly rental of the premises;
3. That upon the signing of this contract, the LESSEE shall deposit unto the LESSOR the
sum of ______ (00) which shall be applied as One (1) Month Advance (00) and One (1)
Month Deposit (00);
4. That should the LESSEE decided to vacate the premises after the term of the contract the
amount of ___________ (00) known as One Month Deposit mentioned in paragraph 3, will
only be refunded by the LESSEE after one month from the date they vacate the premises to
answer for all the unpaid bills and damages if there is;
6. That the LESSORS reserve the right to increase the rental and/or escalation rates of the
leased premises at the reasonable proportions in the events of inflation and/or increase in real
estate proper assessments.
That violation by the LESSEE of any of the condition herein provided shall be sufficient
ground for the LESSOR to terminate and cancel this contract, and the LESSEE shall be liable
to _________- PERCENT (%) of the amount due as liquidated damages exclusive of
attorney's fee and other cost and incidental expenses in an event of court litigation to enforce
any of the provisions of this contract violated by the LESSEE.
