RESULTS AND DISCUSSION

This chapter presents the results during one on one depth interview with

the key informants conducted in Poblacion Kabacan, Cotabato. These were

arranged as follows; (1) the awareness of the residents about the 2017 Martial

Law in Kabacan; (2) the participation of the residents about Martial Law of

Poblacion in Kabacan; and (3) the effects of 2017 Martial Law on the lives of

the residents of Poblacion Kabacan according to their economic aspect and

political aspect and social aspect.

Awareness of the Residents in Martial Law

Martial law is an action taken by the government that allows the military

to increase its powers and immunities in time of insurrection, but preserving, at

the same time, the supremacy of the law and constitution (Ballantine, 2000).

Before the President can declare martial law or suspend the privilege of the

writ of habeas corpus, the 1987 Constitution requires that the President

establish the following: (1) the existence of actual rebellion or invasion; and (2)

public safety requires the declaration of martial law or suspension of the

privilege of the writ to suppress the rebellion or invasion. Needless to say, the

presence of an actual rebellion is necessary before the President is authorized

by the Constitution to declare martial law in any part of the country.

The table 2.1 contains awareness of the key informants in Martial Law.

Most of the key informants (7) mentioned that their perceived idea on martial

law is the presence of curfew. An informant said that as they heard that the

President proclaimed Martial law, they already assumed that there will be

curfews already. That is why, they prefers to stay in their homes. One key

informant mentioned that:

“Pag may Martial Law kasi hindi nawawala yang


curfew kaya pag may Martial Law may curfew tulad
ngayon. Kaya simula noong nagka-curfew, na nanatili
nalang ako sa boarding house pag gabi mahirap nang
mahuli ka ng military pag nasa labas kapa kasi
dadalhin ka nila sa presento.”

It was affirmed by another key informant:

“Ayun narin sa aking narinig na balita ay


magpapatupad daw sila ng curfew dahil may Martial
Law. Simula nung pagkarinig ko ay naisip ko kaagad
na mas nakakabuti kung nasa boarding nalang ako
pag gabi na para maiwasan na magkasala at maging
sagabal lang sa buhay.”

Moreover, Four (4) of the key informants said that they have an idea

that if a certain area is under martial law, the said proclamation will be

effective for 60 days from the day it had been announced, one of key

informants mentioned:

“Sa pagkakaintindi ko sa Martial Law hanggang 60


days lang ito eh.. kasi yun naman ang sinasabi sa
balita kaya naging kampanti din ako dahil ilang araw
lang yung titiisin at ilang araw lang upang matapos na
ang problema n gating governo.”

It was affirmed by another informant:

“Martial Law ay mag exist lang hanggang 60 days


pero pag hindi pa maayos ang situation sa Mindanao
ay mag eextend hanggang bagong taon upang ma
ensure ang kaligtasan ng mamayanan.”

However, there are also key informants (2) who said that there will be a

military takeover that will be responsible for the security of the residents to

ensure the effectiveness of the declaration of the martial law. The key

informants stated that:

“Ang Martial Law ay deneklara ng pangulo kung saan


ang kaguluhan ay hindi na makakaya ng ating mga
police lamang kaya kailangang mag takeover ang
maga sundalo upang madali at maging mas epektibo
ang gawain ng ating government forces.”

(The Martial Law is a declaration by the president


where the conflict is no longer our only police, so the
soldiers must takeover to make the task of our
government forces easier and more effective.)

In addition, one of the key informants mentioned that their perceived

idea about Martial Law is that there is a suspension of rights that would occur

during the implementation of it. According to section 18, article VII of the 1987

Constitution gives the President to propagate the suspension of the privilege

of writ of habeas corpus or place the Philippines or any part thereof under the

Martial Law,” in case of invasion or rebellion, when the public safety requires

it. One of the key informants mentioned:

“Sa aking kaalaman posibleng magkaroon ng


limitasyon sa ating mga karapatan katulad nalang ng
sinasabi nilang suspension of the privilege of the writ
habeas corpus, sa kadahilanan na siguro para
mapamadali ang pag lilitis ng kaso.”

The study revealed that the most perceived idea of the key informants

in Martial Law is the presence of curfews in their community. They already

have the assumptions that there will be strict regulations in terms of the time

that people could wander the streets.

The table 3 above shows the different participation of the key informants

in Martial Law. Seven (7) of the key informants mentioned that their way of

participating in martial law is by bringing their identification cards because

sometimes, militaries ask for it during inspection and especially during night

time. One of the key informants stated that:

“kapag akoy aalis ng bahay lagi kong dala-dala ang


aking ID upang sakaling akoy hanapan ng ID ng
sundalo ay meron akon maipakita, hahanap ka kasi
ng ID lalung-lalo na pag gabi at madali. Hindi kasi
maiwasan na magabihan sa pag uwi mula sa aking
trabaho.”

(When I leave home I always carry my ID so


whenever I find the ID of the sock I will show you, you
will find it by ID especially during the night and easy.
Do not be shy about getting home from work.)

It was affirmed by another key informant:

“sa tuwing akoy nag bababyahe ay laging ko dala-


dala ang aking voters ID kasi dati hinanapan ako ng
ID kaya mula noon ay dinadala ko na upang iwas
narin sa mga violation sa mahigpit na sekyuridad”

(Every time I go there I always carry my voters ID


because I've been working for an ID so since then I've
been taking it to avoid the violations of strict security.)

Aside from that, another affirmation from key informant:

“nang akoy ummalis galing sa boarding house ay lagi


kung dala-dala ang aking ID hindi lang upang
makapasok sa school kundi pag inabutan ako ng gabi
sa pag uwi ay meron akong mapakita sa mga
sundalo pag akoy hinanapan. Balita na kasi sa T.V na
kailangan lagi mong dala ang iyong I.D para hindi
mapagkamalan na terorista.”

(When I left the boarding house always when I was


carrying my ID not just to go to school but when I
arrived at night when I returned home I could show
soldiers where I wanted to go. The T.V news is that

you must always carry your I.D for a non-mistreated


terrorist.)

Another participation of the key informants is by staying in their

respective areas. Three (3) of the key informants mentioned that they prefer to

stay in their homes during curfew hours to help in the implementation and

maintenance of peace within their areas. One of the key informants stated

that:

“pag sumapit na ang curfew ay hindi na ako lumalabas


ng bahay lalong-lalo na pag walang dahilan. Dahil itoy
pinag babawal upang mapanatili ang kapayapaan sa
ating lugar at isa narin sa mga dahilan ay wala naring
bukas na tindahan pag dating ng curfew kayat walang
dahilan upang lumabas pa bahay.”

(when it comes to curfew I'm no longer going out of the


house-especially when there's no reason why it's going
to be a breeze to keep peace in our place and one of
the reasons why there is no open store when it comes
to curfew so there's no reason to went out of the
house).

On the other hand, some participation of the key informants was the

early closing time for establishment. Four (4) of the key informants mentioned

that they follows the mandated time to avoid the punishment from the

government. One of the key informants stated:

patupad ng Martial Law ay sumunod ang pag
sapilitang pag sara nang mga tindahan kabilang na
doon amin dati ay hindi pa gaanong mahigpit ang
kanilang pamamalakad sa curfew pag dating sa pag
sara ng establishemento ngunit ngayun ay pinahigpit
na nila kaya kailangan nanaming sumara bago pa
mag curfew.”

(Since the time of curfew due to the implementation of


the Martial Law was compulsory for the stores,
including where we previously had little control over
curfew arising from the establishment but was
restricted that’s why they need to close before the
curfew.)
It was affirmed by another key informant:

“nagsawa na kaming masabihan ng mga nagroronda


na mga sundalo kaya kami na mismo ang nagsasara
bago pa sila dumating kaya naman kahit hindi pa
nauubos yung binta naming ay pinauubaya nalng
namin sa sumusunod na araw.”

(we were able to tell the nagroronda soldiers that we


were the ones closing down before they arrived so
even though we had not let down our door we were left
behind the following day.)

The study revealed that bringing Identification card is the most ideal thing

to do, to avoid fault in Martial law as the informants said. Security officers

coming from the Armed Forces of the Philippines manning the city for the

protection of the people they inspections for the identity of the person that they

are think one of the spies of terrorist. In addition the government has stated

implementing a “no ID, no entry” policy to ensure that the intruders will be able

to penetrate and disturb the residents (Tubeza, 2017).

C. Political Aspect
 Suspension of magkaroon ng limitasyon sa ating
writ of habeas mga karapatan katulad nalang ng 1
corpus sinasabi nilang suspension of the
privilege of the writ habeas corpus.

The key informants formed their individual statements about the effect

of Martial Law in their lives in economic aspect. Four (4) of the key informants

mentioned that one of the effects of Martial Law in their lives was compulsory

early closing of their establishment because of the curfew that had been given

by the government and aside from that., they are also afraid to what might

happen to them outside their homes. One of the key informants mentioned

that:

“simula nung nag ka curfew narin ay naabala na kami


sa mga posibling mangyari kaya dahil sa Martial Law
kailangan narin naming sumara nang naka ayon sa
kanilang kagustohan malayo man kami sa matao na
lugar ay kailangan parin kasi natatakot kami sa mga
posibleng mangyari pag hindi sumnod curfew.”

(Since then you have curfew that we have been


bothered to do so because of the Martial Law we need
to shut down as they wish we were far away from the
crowded area because we were afraid of the possible
curfew.)

It was affirmed by another key informant:

“Napakalaking pagbabago ang nangyari sa amin dahil


sa sitwasyun namin na mas malakas yung shop
naming pag gabi marami kasing customer pag gabi
lalong lalo na pag dating ng ten (10) ng gabi, ngunit
kailangan na naming sumara bago pa ang curfew at
dahil kung hindi sila na ang magsasara ng shop
namin.”

(What a tremendous change has happened to us


because of our situation that our shop was much more
than a night as a customer during the night especially
when we were ten (10) evenings, but we had to close

before the curfew and because otherwise they're


closing our shop.)

Moreover, other key informants mentioned that another economic effect

of Martial law is the lower income for the people who experienced the said

government action. One key informant said that:

“Kaya dapat before dumating iyong curfew wala na


kami doon sa pwesto. Medyo nakakapanghina nga ng
tuhod kasi talagang nakakabawas talaga siya ng
encome para hindi talaga siya sapat para sa aking
pamilya. Pero iyon nga wala tayong magagawa kasi
para sa ating kaligtasan naman iyon.”

(So before you come curfew we're not in the place. It's
a bit worn by the knee because he really really does
not want to be enough for my family. But that's not
what we can do for our salvation.)

It was affirmed by another informant:

“dahil minsan noong wala pang Martial Law ay nag


babyahi pa ako ng hating gabi para maka income pa
pero sa ngayun himina dahil hindi na ako makapag
byahe pag gabi na kasi may curfew”

(because before the Martial Law I was still going to


spend the night to earn more money but unfortunately
it was reducing my income because of the curfew.)

However, one (1) of the key informant also said that the economic effect

of Martial Law in his life is the delay on their transaction because of the traffic

that they are experiencing due to the inspection produce that are done by the

militaries. Key informant stated that:

“Simula nung nagka Martial Law are naging mahigpit


na mga military sa checkpoint at nang dahil doon nag
karoon ng traffic at naging mabagal at delay ang aking
transaction sa aking produkto.”

(Since then the Martial Law has become very strict


military checkpoints and since there was traffic and my
transaction was slow and delayed in my product.)

The study revealed the most problem of the key informants in the effect

of the Martial Law in their lives was the force to close their establishment. As

what Altez (2017) said since the Martial Law has been executed there must be

a curfew, not only for the people but also to the establishments to ensure that

no one have reason to go out when the curfew start.

B. Social aspect

The key informants mentioned the different social effects of Martial Law

in their lives. There are four (4) of the key informants stated that they

experience difficulty of transportation in Kabacan especially during night time

because of the curfew that had been imposed. One of the key informants

mentioned that:

Simula nung nag Martial Law nahihirapan na akong


makasakay, kaya’t ang ginagawa ko nalng ay
naglalakad pauwi.

It was affirmed by another key informant:

Nahihirapan akong sumakay pag gabi kasi yung mga


sikad driver ay hindi na nag babyahe pag malapit na
ang curfew.

Moreover, there are also key informants stated that since the martial law

has started, they feel safe and protected because of the militaries who roam

around every day and night within the area. Three (3) of the key informants

mentioned that:

“Mas nagiging kampanti ako kasi nga alam ko na


maraming mga tanod at military na rumuronda tuwing
gabi at mas magiging kampante ako kasi alam kong
safe at protected ang pamilya ko. lalo pa’t lalaki ang
mga anak ko, wala silang choice kundi mag stay sa
loob ng bahay tuwing gabi.”

(I'm getting better because I know that there are many


guards and military guerrillas every night and I'm more
comfortable because I know my family is safe and

secure. especially when my children are boys, they


have no choice but to stay indoors every night.)

It was mentioned by another informant:

“Tulad ng naiisip ko pagkatopos maideklara ang


Martial Law maaaring maging comportable ang mga
tao na maglakad sa matao na lugar tulad ng sa
avenue na madalas na pinapasyalan ng mga tao
lalong-lalo na sa mga estudyanti ng USM”

(As I think my vision is to declare the Martial Law it is


possible to felt comfortable for people to walk in
crowded places such as the avenue that people often
enjoy in the USM.)

However, there are also key informants (3) who said that due to the

Martial Law, they have no time to spend with their friends outside their houses

because not only minors are being caught by the militaries during curfew

hours. One key informant mentioned that:

“nang gabing iyon lumabas ako para makipag inuman


sa kaibigan ko bago pa magsimula ang curfew ay
lumabas na ako ngunit sa aking pag uwi ay hindi ko
akalain na mahuhuli ako dahil akala ko minor lng
hinuhuli pero lahat pala pag lumampas sa 10 (ten) pm
na naglalakad pa sa high way ay huhulihin at dalhin sa
presento upang mag paliwanag nag rason mo sa
iyung pag lalakad ng gabi.”

(that night I went out to spend time with my friend


before the start of the curfew I came out but when I

came home I did not expect to be caught because I


thought it was a little bit late but all over 10 pm walking
the highway can be taken and taken to the front to
explain why you are walking the night.)

It was affirmed by another informant:

“Dahil sa pag deklara ng Martial law sa tingin ko umiba


na ang panahon ngayon mahirap na talaga lumabas
pag gabi na lalo na pag dis oras na sa gabi dahil baka
mapagbintangan ka na isang terorista dahil nagging
alerto na ang mga tao dito sa Kabacan at isa pa may
curfew na tayong sinusunod kaya’t aking ginagawa
nalng kay may Martial Law man nag e estay nalng ako
sa boarding house kung mag start na ang curfew.”

(Because of the declaration of the Martial law I think


it's time to change now it's hard to get out at night
especially when it's late at night because you might be

The study revealed that most of key informants mentioned that the

comfortable as the greatest effect in their lives in social aspect of Martial Law

since it was executed in Kabacan. This result was admitted under the

Constitution article VII section 18 stated that the declaration of Martial Law is

requirement for satisfaction of the public safety.

.C. Political Aspect

Martial law does not only economically and socially affect people’s lives

but as well as politically. One of the key informants mentioned that because of

the martial law, it suspends their writ of habeas corpus and it easily processes

the different cases that had been filed on courts. Key informant stated that:

“Pag may Martial Law kasi nagkaroon ng limitasyon sa ating mga


karapatan katulad nalang ng sinasabi nilang suspension of the
privilege of the writ habeas corpus, sa kadahilanan na siguro para
mapamadali ang pag lilitis ng mga kaso “

The study revealed that martial law has different effects on the lives of

the people. Those effects can be economically, socially or politically. Due to

the martial law that had been imposed, people change their lifestyles. Some

affects them negatively. However, there are few as weel who appreciated the

presence of martial law in Kabacan.

Synthesis

In the time of Martial Law many people have been witness the lifting the

law that cause of more corruptions from the recent President. As time passed,

the power, the power got his head, thus losing focus and from that event, he

abused the Philippines by taking away the people’s rights ang powers. Martial

Law also took away his people freedom of speech and petition.
