Dear Hasman,
This Letter serves a formal documentation for the following reported offence against you;
1. ALLEGATION OF OFFENCE
We referred to the Memorandum with the reference number GLOB/HQ/100-4/2 - VOL.2 (114) dated 15th
September 2021 that had been issued to you. Based on the findings by Senior Manager - Mr. Soo Chee Kiong,
you are ALLEDGED of neglecting your assigned supervisory duties for the following areas;

It was reported that you failed to perform effective road inspection at Balung Zone of Tawau District during the
period 1 - 13 October 2021 that resulted in 10 NCRs being issued by JKR during the audit on 14 October 2021.
2. Based on the above allegation, you are hereby deemed to violate the Company’s Policies & Regulations;
As stipulated in Article 8, subsection 8.2.1; Clause 3 Major Misconducts - “Failure to perform work
assignments or refusal to carry out tasks assigned by the Superior without justifiable reasons;
incompetence in work standards and performances; performing inefficiently or unsatisfactorily, or failing
to apply effort on the job, including intentionally showing down work or productivity and deliberately
restricting output.”
Your alleged actions had put the Company in the risk of breaching of the road concession contract with JKR
for the Balung Zone, in which the estimated loss of opportunity as follows;
Annual loss of gross revenue of RM98,676 for R05-R07 concession work at Jalan Indrasabah
Annual loss of gross revenue of RM15,966.48 for R01 concession work at Jalan Kau Sing Baru
Annual loss of gross revenue of RM37,082.12 for R01 concession work at Jalan Kau Sing
Annual loss of gross revenue of RM2,504.88 for R02 concession work at Jalan Kau Sing Baru
Annual loss of gross revenue of RM54,238.91 for R01 concession work at Jalan Kau Sing
Your alleged actions had put the Company in the risk of failing to achieve the objectivity in the JKR and Job
Specification as implicated in the Company’s Concession Agreement with JKR and eventually, affecting the
reputation of the Company.
3. You are, therefore required to revert a REPLY LETTER to the undersigned with your written explanation on
or before 28th October 2021 as to why further disciplinary action should not be taken against you on the
alleged acts of misconducts. Should you fail to reply accordingly, the Company would have no alternative but to
assume that you have no explanation to provide. Hence, the Company shall not hesitate to institute further
disciplinary against you accordingly within the purview of Sabah Labour Ordinance, which is TERMINATION OF
CONTRACT for this Case in discussion.
4. In view of the above allegations that considered as severe offence, you are suspended from work, for
fourteen (14) days with half wages effective 26th October 2021 until 10th November 2021 while waiting for
further investigation to be held. You are also reminded that the duration of your suspension of work may be
extended and it is automatically without notice at full pay after the 14 day suspension period expires.

4.1 During the suspension period:
4.1.1 You are required to provide your telephone number, latest address and personal e-mail
address to be contacted by the Company. You are also required to be contacted at any time within the
period of suspension of the service if it is required by the Company to make an investigation in this
case.
4.1.2 You are prohibited from entering the company premises or any company premises without the
approval of the Management.
Please acknowledge your acceptance of this letter by signing and returning the duplicate copy to the
undersigned.
