AFFIDAVIT
I, V.V.S.NageswaraSarma S/o Late. Sri V.R.N. Sastry, Age:42 YEARS

(05.05.1975 as per school certificate), Occ: private employee R/o. 601,
pooja residency OppNaren Garden, Miyapur, Hyderabad 500049, do hereby
solemnly affirm and sincerely state on oath as follows:
1. I submit that, I am the Deponent herein and the petitioner No.3 in the main
OP as such I am well acquainted with facts of the case.
2. I submit that, on 11.06.1986, my Mother namely SmtV.Seetharamamma

@Seethamma who is the Respondent No.3 herein along with her minor
children namely V.Ramakrishna (son), V.nageswarasarma ( Minor son),
V.sailaja (minor daughter) and V.phanikumar(minor son) filed claim petition
U/S. 110-A of M.V. Act claiming compensation of Rs. 1,50,000/- for the
death of my Father Late V.R.N. Sastry.
3. I further submit that, by order and decree Dt 21.11.1988, this Hon’ble court
awarded compensation for a sum of Rs. 78,760/- with pro-costs and 12%
interest per anum from the date of claim i.e., 11.06.1986 till the date of
realization holding that the respondents Nos 1 and 2 herein are jointly and
severally liable to answer the claim. As per the order 50% of the claim was
ordered to be paid to the petitioners 1&2 namely my mother and elder
brother while directed the remaining 50% of the compensation to be kept in
fixed deposit to the account of the minor children namely petitioners 3-5
therein while entitling the mother to take interest on the same. The
compensation amount of Rs.39,380/- was awarded to claimant No.1 and
claimant No 2 which was cashed by her.
4. I further submit that, as per the order of the Hon’ble court the share of
claimant No. 3 to 5 is kept in fixed deposits and I am entitled to 1/3 rd share
in the same.
5. I submit that as on the date of filing of the OP my age was 10 years and now
I am became major and I am now aged about 42 years old, the same was
declared me as a major vide I.A.No.141 of 2018 in O.P.No.185 of 1986 by
this Hon’ble Court. Later, I filed the call for FDR petition and the same
was allowed by this Hon’ble court, Since I am major and I am entitled
to draw the amount of Rs.1,64,143/- up to date 11.12.2018 to my
share which was deposited before this Hon’ble Court towards my share
in the claim.
6. I further submit that my claim amount was deposited in the form of FDRs
before this Hon’ble Court and now my age is 42 years old as per my School
Certificate Records the same was confirmed by this Hon’ble Court.
7. I submit that I am having S.B. Account No. 10276334808 in State

Bank of India, Yellareddyguda Branch,Ranga Reddy District.
Therefore, it is prayed that this Hon’ble Court may be pleased to

issue a cheque for Rs.1,64,143/- (One Lakh Sixty four Thousand one
Hundred and Forty three Only) up to date 11.12.2018 in favour of
me and the same may be credited in my S.B. Account No.
10276334808 in State Bank of India, Yellareddyguda Branch,
Ranga Reddy District and pass such any other order or orders as this
Hon’ble Court deems fit and proper, in the interest of Justice.
