Anthony Fox Order

The Court of Appeals granted Anthony Fox's motion to expedite the mandate reversing his conviction for culpable-negligence manslaughter. The court had issued an opinion on January 30, 2024 reversing and rendering Fox's conviction. Fox requested to expedite the typical 21-day period for the mandate to issue because neither party planned to file a rehearing motion. The Attorney General's office, which had confessed error and sought reversal, did not object to expediting the mandate. Therefore, the court granted the motion and ordered the mandate to immediately issue.

IN THE COURT OF APPEALS OF THE STATE OF MISSISSIPPI

No. 2022-KA-00988-COA

ANTHONY GERALD FOX Appellant

v.

STATE OF MISSISSIPPI Appellee

EN BANC ORDER

This matter comes before the Court en bane on Anthony Fox's motion to expedite

mandate. On January 30, 2024, this Court handed down an opinion reversing and rendering

Fox's conviction for culpable-negligence manslaughter. "Unless otherwise ordered, the

mandate of the Court of Appeals shall issue 21 days" after a judgment is issued or a timely

motion for rehearing is filed, or unless this Court otherwise directs entry or a stay of the

mandate. M.R.A.P. 41 (b ). Fox requests that this Court expedite the issuance of the mandate

because neither party to this appeal will file a motion for rehearing of this Court's decision,

and there is no reason to delay the mandate. Fox states that the Mississippi Attorney

General's Office, which confessed error and sought reversal of Fox's conviction on appeal,

"is not filing a motion for rehearing, nor does it object to the Appellant's request to expedite

the twenty-one (21) day mandate." The motion is well taken.

IT IS THEREFORE ORDERED that Anthony Fox's motion to expedite mandate is

granted. The mandate shall immediately issue upon entry of this order.

SO ORDERED, this the ~ y of February, 2024.
