A written complaint dated 18.12.2023 from Sh. Sum it Oswal, Rio B-1022, Green
Field Colony Faridabad, Haryana has been received in this branch and copy thereof is

enclosed herewith.
The Complaint and subsequent Verification Reports dated 18.12.2023,
19.12.2023 and 21.12.2023 by CBI, ACB, Delhi, prima facie discloses commission of
offence punishable u/s 7 of PC Act 1988 (as amended in 2018) on the part of Sh. Arun
Navariya, Councillor, MCD, Ward No. 166, Pushp Vihar, New Delhi. The Verification

Reports are enclosed herewith.

Hence, a regular case uls 7 of PC Act 1988 (as amended in 2018) is registered
against Sh. Arun Navariya, Councillor, MCD, Ward No. 166, Pushp Vihar, New Delhi
and entrusted to Sh. Satish Kumar Bana, Inspector, CBI, ACB, New Delhi for

investigation.

 VERIFICATION MEMO DATED 18.12.2023 IN CO- 60/2023 of CBI ACB New Delhi

As per the direction of SP/CBI/ACB/Delhi to verify the allegations of complaint

dated 18.12.2023 made by Sh. Sumit Oswal a team mentioned as under was formed:

Sector-1, R K Puram, New Delhi, Independent witness
3. Bhupender Singh Yadav, Inspector of Police, CBI, ACB, New Delhi
4. Shri Shashant Jha,, Sub-Inspector of Police, CBI, ACB, New Delhi
It is alleged in the complaint that Shri Arun Navariya Councillor, MCD Ward No. 166
Pushp Vihar New Delhi demanded a bribe of Rs. 3,00,000/- from the complainant Shri
Sumit Oswal who is running a building construction business and carrying out building
construction at G-2, 107 Madangir, New Delhi and H-2, 333/334, Madangir, New Delhi.
Shri Arun Navariya who is Councillor of MCD ward no.166 got demolished both his
constructions and demanded Rs. 3,00,000/- for allowing him to carry out the

constructions.

Since, the complainant did not want to pay the bribe to Shri Arun Navariya
Councillor, hence, he has given this complaint for taking legal action against Shri Arun

Navariya.

The aforementioned team assembled at O/o SP CBI ACB New Delhi and the
purpose of assembly was informed to all present.

It was decided to leave for Madangir to meet Shri Arun Navariya (hereafter called
SO) at his office. Accordingly, at around 15:40 Hrs., the CBI team along with the
complainant left the CBI office in the vehicle of complainant.

In order to verify the allegations, a new Black color Sony make Digital Voice
Recorder (hereinafter referred as DVR) & new ADATA 16 GB SD card were arranged.
After ensuring the blankness of the DVR, the said SD card was inserted in the DVR.
After ensuring the blankness of the SD card, the introductory voice of the above said
independent witness was recorded in the said SD card through DVR.
 Team reached near Saket Court at around 16:15 Hrs and parked the vehicle at a
safe distance from office of SO. It was decided to send the complainant and
independent witness to meet the SO in his office. The independent witness was also
directed to remain present in the vicinity and to overhear the conversation which may
take place between the complainant and the SO, if possible. The DVR was kept in
jacket worn by complainant in recording and hold mode and the complainant was sent
to meet the SO at about 16:21 Hrs.

The complainant and independent witness left to the office of Shri Arun Navariya
in Madangir and returned around 17:27 hrs near Saket Court Chowk as directed earlier.
Afterwards, the DVR was taken back from the complainant and switched off after
removing recording and hold mode. The complainant was asked to narrate the incidents
on which he said that, he and witness went to MCD Sanitation Inspector office Pushp
Vihar, where the SO used to sit sometimes. However, the SO was not found there.
Subsequently, the complainant made a call from his mobile number 8810637937 to the
mobile number of SO i.e 9899454551 on whatsApp. During the said call, the SO told
him that he is in his office at 1-2 Block, Madangir. The said call was made by keeping
the phone in speaker mode and the same is recorded in the SD card through DVR.
After reaching the office of Shri Arun at 1-2 Block, Madangir, SO asked the complainant
and independent witness to sit in the park infront of his office. SO also offered tea to
complainant and independent witness and held general talks for a while. Thereafter, SO
took the complainant and witness inside his office and after few minutes, SO asked
independent witness to wait outside. Accordingly, the independent witness went out and
waited in park in front of office of SO. In the meantime, while meeting with the
complainant, during the conversation, the SO demanded Rs. 1 lac for a site and Rs. 2
.-·-~-¼'·~-... lacs for another site by writing the amount on a paper. Complainant negotiated and

%,}9!4#asked the SO to reduce the amount. After negotiation, the SO agreed to accept Rs. 2.5

\~fifacs in total for both the construction sites. Complainant informed the SO that a part

·gf payment would be arranged and given to him tommorrow i.e. 19.12.2023. The SO
further informed the complainant that he would send some other person to collect the
bribe amount. Complainant requested SO not to send any local and known person for

 acceptance of bribe to which SO agreed. SO also gave assurance to the complainant
that nobody would trouble his construction for next 10 days.

Thereafter, the witness was asked to narrate the incident upon which he said that
he and complainant met Shri Arun Navariya and had a tea with him. After having some
general talks, Shri Arun Navariya asked him to wait outside, accordingly, he came out
from his office and waited in park in front of his office. Shri Arun Navariya and
complainant had a discussion in his office and after sometime complainant and Shri
Arun Navariya came out and he along with complainant sat in complainant's car and
reached near Saket Court Chowk.

Thereafter, the CBI team including independent witness and complainant left the spot
and reached CBI, ACB, Delhi office at around 18:45 hrs. The Memory Card was taken
out from the DVR and an investigation copy of Memory Card was prepared with the help
of Write Blocker. The recorded conversation was heard which corroborated the version
of the complainant.

The Memory Card was then kept in its plastic cover. Then the plastic cover was kept in
ils original paper cover which was signed by VO Sh. Bhupender Singh Yadav,
independent witness and the complainant and marked as "Q-1 in CO-60/2023". Then
the paper cover was kept in an envelope and sealed with CBI Seal in the presence of
Independent Witness. The envelope was signed by VO, independent witness and the
complainant. The envelope was also marked as "Q-1 in CO-60/2023" and taken in
police possession vide this memo.

3f;jj The specimen seal impressions in ink are being taken on each and every page of this
38$$$%$ii$l verification memo. The specimen seal impressions in ink and lac were also taken on
?%hi lain paper under the signature of independent witness and the verification officer. The
seal is being given to the independent witness Sh. Chandra Mohan Meena with the
direction to produce it as and when required by lawful authority. The DVR was also
given to Shri Chandra Mohan Meena with the direction to bring the same tomorrow.
The verification memo was prepared in CBI office. The proceedings of this memo
concluded 21 :30 hrs today. This memo is being signed by the verification team including
independent witness, the complainant in token of its correctness.

The above said verification revealed that Shri Arun Navariya, Councillor, MCD, ward
No. 166, Pushp Vihar, New Delhi demanded illegal gratification of Rs. 2,50,000/- from
the complainant. It is recommended that a regular case may be registered against Shri
Arun Navariya, Councillor, MCD, Ward No.166, Pushp Vilar, New Delhi under Sec. 7 of
PC Act 1988 (As amended in 2018).

 FURTHER VERIFICATION MEMORANDUM IN CO-60/2023 dated 19.12.2023

In furtherance to the Verification Memo dated 18.12.2023, a team comprising of

Verification officer Sh.Bhupender Singh Yadav, Inspector along with Sh. Sashant
Jha, SI and independent witnesses namely Sh. Chandra Mohan Meena and Sh. Sonu,
both MTS, CWC, New Delhi was constituted under the supervision of SP, CBI, ACB,
Delhi for conducting further verification in the present matter.
All the verification team members left for the spot at about 15:15 Hrs in a
vehicle and reached near Madangir at about 15:35 hrs and parked the vehicle in an
obscure manner. It was informed by the complainant that the SO being MCD Councillor
attends meetings in the locality, hence before going to his office, a call should be made
to know his whereabouts. He further informed that the SO picked only whatsapp calls.
Accordingly, at about 15:38 hrs, a whatsapp call was made from the mobile phone no.
8810637937 of the complainant to the mobile phone No. 9899454551 of Sh. Arun
Navariya to know his whereabouts, by keeping the mobile phone of the complainant on
loudspeaker mode in the presence of independent witnesses. The call was picked up by
a lady who informed that Sh. Arun Navariya is outside and left his mobile phone with
her. On that, the complainant told the lady to inform Sh. Arun Navariya to call the
complainant back when he returns. The conversation was simultaneously recorded in
the memory card through DVR.
The team thereafter maintained some safe distance from the spot and waited for
the call of accused but the complainant did not receive any call from him. Hence, it was
decided to further make a whatsapp call to SO. Therefore, at about 17:34 hrs, a
whatsapp call was again made from the mobile no. 8810637937 of the complainant to
the mobile No. 9899454551 of Sh. Arun Navariya by keeping the mobile phone of the
complainant on loudspeaker mode in the presence of independent witnesses. Again, the
call was picked up by the same lady and informed that Sh. Arun Navariya has just
arrived and asked the complainant to come. The conversation was simultaneously
recorded in the memory card through DVR.
Accordingly, the verification team again proceeded nearby vicinity of the office of
Arun Navariya. The independent witness Chandra Mohan Meena was told to follow the
complainant from a close distance but should avoid being exposed so as to arise any
 suspicion in the mind of the SO. The DVR was kept inside the jacket of the complainant
in recording and hold mode and he was directed to proceed to the office of Arun
Navariya. The complainant proceeded to the office alongwith the independent witness
and other team members remained at safe distance in a discreet manner. The
complainant was seen roaming outside the office for a long time, which was at ground
floor of the building. After some time SO came to his office and it was seen that he
(SO) alongwith the complainant entered in the office of SO. After 20-25 minutes, the
complainant was seen coming out of the office of Sh. Arun Navariya. The complainant
came back to the official vehicle and DVR was taken back and switched off.
The complainant was asked to narrate the sequence of events who informed
that upon reaching the office of Arun Navariya, it was found to be locked from outside.
So, he made a whatsapp call at around 19:00 hrs from his mobile no. 8810637937 to
the mobile phone No. 9899454551 of Sh. Arun Navariya. The call was not picked up by
Arun Navariya. Thereafter, at around 19:02 hrs, Sh. Arun Navariya made a whatsapp
call to complainant. He (the complainant) put his phone on speaker mode and the
conversation was recorded in the memory card through DVR. In the said call, Arun
Navariya informed the complainant that he (Arun Navariya) would reach at the office in
5 minutes.

The complainant further narrated that, he waited at office for some time.
However, Arun Navariya did not arrive for a long time, he (complainant) again made a
whatsapp call from his mobile to Arun Navariya at around 19:38 hrs. by keeping the
phone on speaker mode. In the said call, Arun Navariya informed that he would reach
at the office in 2 minutes. The conversation was recorded in the DVR. According to the
narration, at around, 19:40 hrs, a boy came at the office. The boy confirmed from the
complainant, if he came to meet Arun Navariya. After confirming, the boy made a
whatsapp call at around 19:41 hrs.from the mobile of complainant to Arun Navariya
and informed Arun Navariya that the office is locked and asked about the whereabouts
of the key. This time, the phone was not put in speaker mode. After few moments, at
around 19:42 hrs., the complainant again made a whatsapp call from his mobile no.
8810637937 to the mobile No. 9899454551 of Sh. Arun Navariya by keeping the phone

on speaker mode. Arun Navariya on the call, informed that he would reach in 2
minutes.
The complainant further narrated that after few minutes, Arun Navariya arrived
there and opened the office. After talking for few minutes in office, Arun Navariya
directed complainant not to involve Deepu and informed him that he would send a new
person and directed complainant to speak to him. He (Arun Navariya) further informed
that he would call him (complainant) in this regard. The date and time of obtaining the
bribe was not disclosed by SO. SO further assured the complainant that nobody would
trouble his undergoing construction building for next 10 days.

Thereafter, the verification team came back to the CBI office and the memory
card used for recording the conversation was taken out from the DVR. A copy of the
memory card was prepared by using the write blocker device on the laptop in the
presence of both the independent witnesses. The said memory card was then kept in
its original cover and the cover was signed by both the witnesses, complainant and VO
and the cover marked as "Q-2 in CO-60/2023". This cover was again kept in an
envelope and this envelope was sealed with CBI brass seal and marked as "Q-2 in CO-
60/2023". Both the independent witnesses, complainant and VO signed this brown
envelope.
Thereafter, the recorded conversation was heard from the copy of the recorded
conversation, which corroborated the version of complainant.

The DVR used for recording conversation between SO and the complainant and
CBI brass seal used for sealing the memory card has been handed over to Sh. Chandra
Mohan Meena, Independent witness for safe custody with the direction to produce
before the lawful authority as and when required.

The facsimile impression of the brass seal used for sealing the memory card has
been taken on each page of this memorandum and also on separate white papers for
sample seal in wax and ink. These papers were also signed by both the independent
witnesses and VO.

 The memorandum has been prepared on the official laptop of VO, read over,
explained in vernacular to all present and all have signed on each page of this
memorandum in token of correctness of facts mentioned therein.

During the verification, the name of person who would collect the bribe amount on
behalf of SO could not be ascertained. The date and time of obtaining the bribe is also
not disclosed by SO. Therefore, the verification proceedings may be kept open for
further verification.
The Memorandum proceedings concluded at Office of SP, CBI, ACB, New Delhi at
about22:00 hrs on 19.12.2023.

Report on verification in CO-60/2023 in respect of demolition of buildings which
are under construction:

As per direction of SP, CBI, ACB, New Delhi, the spot verification of two
construction sites as shown by the complainant was discreetly conducted today i.e.
21.12.2023. During the verification, RCC roof lanter of both the under construction
buildings at G-2, 107 Madangir, New Delhi and H-2, 333/334, Madangir, New Delhi
were found to be demolished partially.

The antecedents of Shri Arun Navariya, MCD Councillor were also checked in his
locality which revealed that Shri Arun is a corrupt person and indulged in corrupt
practices.
