Who: (Victim) Mr. Ernesto Jordan Llemit, 29 years old, born on December 12, 1994, Male,
Married, Government Employee and a resident of Purok 1, Barangay 23, Gingoog City, Misamis
Oriental.

Why: Under Investigation
How: Around 3:05 P.M. Mrs. Kayla Galope Waminal a concerned citizen called this office
through the Police hotline number that there was a Dead body at Purok 3, Barangay 23 (Gahub
River) Gingoog City. Immediately QRT personnel led by PSSG John Russel Villanueva
Obedencio together with IOC proceeded to the area, upon arrival thereat, they found the dead
body lying on the ground in a prone position with gunshot wound on the back of the head, in the
side of the river. Wherein the responding officer secured and cordoned the area Requested for the
Misamis Oriental Provicial Forensic Unit 10 for the assistance at the crime scene, recovered from
the crime scene is one(1) Cartridge case of 45 caliber.

FOUND DEAD BODY (MURDER)
On or about 3:05 o’clock in the afternoon, Mrs Kayla Galope Waminal, a concerned
citizen, 36 years old, born on January 23, 1988, female, married, a resident of Purok 1- A,
Barangay 23, Gingoog City, reported that there was a dead body at Purok 3, Barangay 23 (Gahub
River), Gingoog City. Immediately after, QRT personnel, led by PSSg. John Russel Villanueva
Obedencio together with the IOC proceeded at aforementioned place and the responding officer
secured and cordoned the area, The victim identified Mr. Ernesto Jordan Llemit, male, 29 years
old, born on December 12, 1994, married and a resident of Purok 1, Barangay 23, Gingoog City
was lying on the ground (Prone Position) with gunshot wound on the back of the head at in the
side of the river. Investigation revealed that victim and his wife were attending their
goddaughter’s birthday at P-3, Brgy 23 of this city. The wife, Mrs. Myra May Salinay Llemit, 28
years old, born on December 3, 1995, female, married, and a resident of P-1, Barangay 23,
Gingoog City saw her husband and certain Sherwin Cabeltes Tuto drinking two(2) cases of beer.
The two decided to buy more beer but were unable to return. Mrs. Llemit was only informed of
the discovery of her husband’s dead body by the one of the visitors from the same birthday party.
Furthermore, This office requested assistance from Misamis Oriental Provincial Forensic Unit 10
for processing the crime scene. A Cartridge Case of 45 caliber, was recovered from the crime
scene.
Incident happened on or about 3:00 o’clock in the afternoon of April 10, 2024 at Purok 3,

2. Please be informed that on or about 3:05 o’clock in the afternoon Mrs. Kayla
Galope Waminal, a concerned citizen called this office through the Police hotline number
with contact number 09066139294 that there was a Dead body at Purok 3, Barangay
23(Gahub River), Gingoog City, Misamis Oriental.
3. Immediately QRT personnel led by PSSg. John Russel Villanueva Obedencio

together with the IOC proceeded to the area, upon arrival thereat, they found the dead
body of the victim lying on the ground in a prone position with Gunshot wound on the
back of the head, at the side of the river wherein the responding officer secured and
cordoned the area victim identified as Mr. Ernesto Jordan Llemit, 29 years old, born on
December 12, 1994, male, married, Government employee, and a resident of Purok 1,
Barangay 23, Gingoog City, Misamis Oriental.
4. Investigation revealed that according to the statements of the wife of the victim
Mrs. Myra Salinay Llemit, 28 years old, born on December 03, 1995, female, married,
housewife, and a Resident of Purok 1, Barangay 23, Gingoog City, Misamis Oriental, that
on April 10, 2024 she saw Mr. Sherwin Cabeltes Tuto (Suspect), 30 years old, born on
September 22, 1992, male, single, retired army, Resident of Purok 2, Barangay Lunao,
Gingoog City, who admired her since college but she chooses Mr. Ernesto Jordan Llemit.
Her husband and the suspect was drinking a two (2) case of beer. Mr. Sherwin Cabeltes
Tuto wanted to buy more beer, then he would like to buy with the victim and the store is
across the river. On or about 2:45P.M. the two decided to buy more beer but were unable
to return. After she waited 15 minutes, she was nervous for the reason that Mrs. Alpha
Albores was shouting that there was a dead body. Another from a godmother Mrs. Alpha
Albores, 34 years old, born on February 23, 1990, married, Resident of Purok 3,
Barangay 23, Gingoog City, Misamis Oriental, According to her, she witnessed Mr.
Sherwin Cabeltes Tuto at on or about 3:00P.M. at the dike holding a pistol running
towards his motorbike. She was curious so she went to the river where the suspect came
out and she found a dead body of Mr. Ernesto Jordan Llemit.
5. This station has already coordinated with the SOCO PNP Crime laboratory
office, Misamis Oriental Provincial Forensic Unit 10 and had processed the crime scene
and gathered pieces of evidence recovered from the scene 1 Cartridge Case of 45 caliber
6. That the cadaver was already transported at St. Peter Funeral Homes situated at
National Highway, Barangay 20, Gingoog City and post mortem examination was
requested to address to SOCO.
7. Hot pursuit operation conducted by personnel of this station for possible

apprehension and for filing case/charges against the suspect. Incident happened at
aforesaid time, date and place.

2. This pertains to the Hot Pursuit operation in relation to Found Dead Body

Misamis Oriental, with the help of the witnesses who identified the suspect.
3. The suspect was arrested at his cousin’s house at Purok 2, Barangay Lunao,
Gingoog City, Misamis Oriental Led by PSSg. John Russel Villanueva Obedencio and Pcpl
Joseph Bagnol Cesario together with the Civilian Volunteer Organization (CVO).
4. Suspect apprehended and was brought to this station on April 10, 2024 and case
of Murder was filed against the suspect in inquest proceeding under NPS no. X- 07-INQ-24J-

FACTS OF THE CASE:
On or about 3:00 o’clock in the morning, Mrs. Myra Salinay Llemit, 28 years old,

POSTMORTEM FINDINGS:
The Body is incurred closed range penetrating gunshot wound, posterior cervical spine.
A. The bullet causes extensive damage to the cervical spine and to the bases of the brain
tissue, and a distorted. Copper jacketed and medium cilaber bullet is ledged and
recovered in the sinus.
B. There is a zone of soot around the entrance wound
C. Direction of the wound track: posteroanterior and slightly upward.
CONCLUSION: THE GUNSHOT WOUND BREAKS THE CERVICAL SPINE THAT

CAUSES THE DEATH

I, John Russel V. Obedencio, 35 years old, born on September 28, 1989, Married, and a
resident of Purok 2 Mango Street, Paz Village, Barangay 24-A, Gingoog City, Misamis
Oriental, a member of Philippines National Police, assigned in investigation section,
and a Police Staff Sergeant.
I, Joseph B. Cesario, 31 years old, born on October 24, 1994, Married, and a resident of
Barangay 18, Gingoog City, Misamis Oriental, a member of Philippines National Police,
assigned in traffic section, and a Police Corporal.
We have sworn an oath in accordance with the law and dispose as follows;
That, we are the arresting officers during the arrest of suspect Sherwin “Taks” Cabeltes
Tuto, 30 years old, born on September 22, 1993, Male, Single, Retired Army, residents of
Purok 2, Barangay Lunao, Gingoog City, Misamis Oriental. The arrest was transpired at
around 7: 00 in the evening of April 10, 2024 at his own house.
The onset of the incident was, after a nonstop and thorough investigation conducted by
our office in relation to a Found dead body transpired at aforesaid place, investigators
obtained a strong facts and evidence about the identity of the culprit after witnesses’
surface and identified the aforesaid suspect whose responsible to the death of the latter.
Thus we, together with PLTCOL Cecelio Q. Orcullo our Chief of Police, PSSg. John Russel
V. Obedencio and PCPL Joseph B. Cesario conducted hot pursuit operation
subsequently proceeded at aforesaid place of incident of arrest in Purok 3, Brgy 23
Gahub River Gingoog City Misamis Oriental, together with the personnel of Gingoog
City Police Station and Civilian Volunteer Organization (CVO) in the aforesaid
Barangay. upon arrival in the area, with the help of the confidential informant (CI),
whose identity withheld for security purposes handle by personnel of this station, the
aforesaid suspect was identified as Sherwin Cabeltes Tuto, Male, 30 years old, born on
September 22, 1993, Single, residents of Purok 2, Barangay Lunao, Gingoog City,
Misamis Oriental. Furthermore, we informed that the said incident was recorded to the
PNP issued body camera worn by PSSg. John Russel V. Obedencio and PCPL. Joseph B.
Cesario, the aforesaid suspect was brought to the Police station for proper disposition.
