Howard Parry (Purchaser) contains the following
covenants:-

THE Purchaser for himself and his successors in


title owner or owners for the time being of all and
every part of the land hereby conveyed hereby
covenants with the Vendors to the intent that such
covenant shall enure for the benefit of the
remainder of the land belonging to the Vendors and
to the further intent that this present covenant
shall bind the land into whosesover hands the same
may come but not so as to render the Purchaser or
his successors in title liable in damages for any
breach after he or they respectively shall have
parted with all interest in the said land that the
Purchaser and his successors in title as aforesaid
will perform and observe the restrictions and
provisions set out in the Second Schedule hereto.

The SECOND SCHEDULE before referred to:-

1. No building shall at any time be erected on the


land other than one private dwellinghouse with or
without a garage or other suitable outbuildings and
outoffices according to plans and specifications
approved by the Vendors or their surveyors.

2. Any such dwellinghouse shall at all times


hereafter be used as a private dwellinghouse only.

3. Not to erect on the land or attach to any


erection thereton:-

(a) Any pole used or to be used in connection with


any "wireless" installation or to carry over the land
any wire or wires for the purposes of wireless
transmission or reception.

(b) Any name plate sign or notice whatsoever other


than a notice indicating the number and/or name of
the premises or such other professional name
plates or signs as may be approved by the Vendors.

4. At all times hereafter to maintain the grass


verges in a neat and proper condition.

5. In the case of all plots subject to a building line


such building line shall be observed."

2 1994-08-11 The land is subject to the following rights reserved


by the Conveyance dated 15 September 1936
referred to above:-
"EXCEPT AND RESERVED unto the Vendors (i) all
rights of way light and air which would or might
restrict the free and unrestricted user of the
adjoining or neighbouring land of the Vendors for
building purposes and (ii) all rights of drainage and
the free passage and running of water and soil gas
and electricity from and to adjoining or
neighbouring land and by and through all pipes
drains channels sewers and watercourses now laid
or hereafter to be laid under or on the said property
or any part or parts thereof and the right to connect
up with and use all such pipes drains channels
sewers and watercourses and to enter upon the
said property or any part thereof and repair and
execute all works in the exercise of any of such
rights as aforesaid"
