    Dear Mr Nightingale Your request for information Thank you for your email of 15 January 2012, which was received by us via whatdotheyknow.com on the same day. You have requested information in relation to two Ofsted inspections of Burwood School in connection with injuries sustained by a member of staff at the school. Summary of response We do not hold specific information in relation to your request but have provided some general information which you may find helpful. The Freedom of Information Act We have dealt with your request in accordance with the Freedom of Information (FOI) Act 2000. The first requirement of the Act is that we should confirm whether or not we hold information of the description set out in your request. I can confirm that we do not hold the evidence from the inspections of Burwood School in either 2011 or 2009. Neither do we hold any information about the injuries sustained by a member of staff at the school. Ofsted has a policy whereby it retains the evidence base from inspections for six months following the date of an inspection taking place. In this case, I regret that the evidence bases for both inspections have been destroyed in line with our retention policy and are therefore no longer available for us to examine. As a consequence, we are unable to consider the evidence to ascertain the full picture

    surrounding these particular inspections and therefore are unable to answer your specific questions. However, in respect of concerns expressed by parents and carers in the 2011 inspection, the report indicates that only eight completed questionnaires were returned although there were 44 pupils in the school at the time. The negative views expressed were those of a very small number of parents and carers. The views of pupils, parents and carers and staff were clearly taken into account and reported upon in the inspection report. I regret it is not within Ofsteds powers to investigate concerns about the treatment or actions of individual members of staff. This is because Ofsted has no jurisdiction over, and cannot directly influence, decisions about employment matters. I trust that this letter clearly explains our position and provides you with some information in relation to your request.
