Objectives of the Session
1. To make the participants understand the
Environmental Safeguard requirements in the
Project;
2. To present the Environmental Assessment and
Review Framework (EARF) applicable for the
Project;
3. To exchange information and experience, and
recommend the best practices;
4. To respond to any queries of the participants
on environmental safeguard in the project.

Environmental Safeguard
Requirements in the IUDP

All Safeguard Matters shall be guided by:

• Safeguard Policy Statement 2009 of ADB

• EPA and EPR of the GON

• EARF of the Project


Objective:
Better access to municipal infrastructure and
services in a socially inclusive manner.

Municipalities:
•Dharan,
•Janakpur,
•Nepalgunj, and
•Siddharthanagar

• Drainage and Sanitation systems

• Solid waste management with RRR principle

• Urban roads with premix carpeting

• Water supply system

• Community development programs in poverty

Environmental Safeguard Documents Prepared:

• Draft IEE and EMP for Dharan

• Draft IEE and EMP for Nepalgunj

• Draft IEE and EMP for Siddarthanagar

• Draft IEE and EMP for Janakpur

• An Environmental Assessment and Review


Framework (EARF) for other small components to

be defined after ADB Board approval.

Part 2:
What to do with the
Draft IEE and EMP?

Schedule 1 related to rule 3 of EPR of GON:
IEE is required for following projects-
• Urban Roads. New urban roads
• Solid waste management.
IEE EIA
 Annual 1000-5000 ton SWM  SWM for >10000 population
 5-10 ha transfer station  Annual >5000 ton SWM
 5-10 ha waste recycling area  >10 ha transfer station
 5-10 ha compost plant  >10 ha waste recycling area
 >10 ha compost plant

• A sewerage system of more than Rs5 million cost


• Addition of new source and supply water for 10000-100000
population
• Re-check environmental categorization

• Update and finalize Draft IEE and EMP

• Fulfill EPR requirements (IEE ToR approval,


publication of notice etc.)

• Submit for GON approval

Recommendations of EMP:

• Refer IEE and EMP for detailed design and


include recommendation with cost

• Insert clear BOQ for safeguard requirements

• Regular consultations with the affected


persons during the detailed design and
construction

• Establish a Grievance Redress Mechanism as


committed by the Proponent in the IEE
• PCO to appoint an Env. Staff to oversee
compliance with the EMP, public
complaints, PIU environmental monitoring,
and reporting to ADB.

• Prepare structured safeguard compliance


monitoring system with standard checklist

• Prepare a standard safeguard reporting


format
Part 3:
The EARF
Where will be the EARF applicable?

Para 48 of PAM (Section VII- Safeguards):

The EARF will be applicable for the minor components of


the project where locations will be decided after Board
approval. These include:

• Infrastructure under Community development


programs;

• Tube wells in Dharan, and

• Solid Waste Transfer Stations in Janakpur, Nepalgunj


and Siddharthanagar Municipalities

Environmental Screening
GoN: Environment Protection Rule, 1997 (2007)
• Schedule 1: Projects requiring IEE
• Schedule 2: Projects requiring EIA
ADB: Based on REA Checklist
• Category A: Projects with significant impacts.
EIA is required.
• Category B: Projects with some impacts, but
less than Category A. IEE is required.
• Category C: Projects unlikely to have adverse
impacts. DDR is required.
• Category F: Projects where Financial
Intermediary is involved.

What does the EARF guide?

• All IEEs are required to follow the procedures


outlined in the EARF.

• In the event impacts are minor, the existing IEEs


and EMPs prepared for each town can be
updated to reflect the findings of the
environmental assessment.

• All environmental documents will be endorsed


and approved by the EA and cleared by ADB.

• Applicable Acts and Rules
• Environmental Assessment Procedures of Nepal
• Anticipated Environmental Impacts
• Environmental Assessment for Subprojects or Components
• Environmental Criteria for Subproject Selection
• Specific Procedures for Environmental Assessment
• Consultation, Information Disclosure, and Grievance
Redress Mechanism
• Institutional Arrangement and Responsibilities
• Monitoring and Reporting
Institutional Arrangement
• Executing Agency MPPW
• Implementing Agency DUDBC
• Project Coordination Office (PCO) at DUDBC with an
Environment Staff
• PCO supported by Project Management Support Consultant
• PIU in Municipalities
• Municipal Project Management Committee (sort of steering
committee)
• PIU supported by Design and Supervision Consultant. Env.
Monitoring Sp. of DSC will monitor contractor’s safeguard
compliance and report quarterly to PCO.
• PCO will submit semi-annual environment compliance
report to ADB.

What is a Safeguard Monitoring
Report?
Article I, Loan Regulations and Grant
Regulations; Definitions of Loan Agreement:

“Safeguard Monitoring Report” means each


report prepared and submitted by the
Beneficiary to ADB that describes progress with
implementation of and compliance with the
EMP, the RP and IPP (as applicable), including
corrective and preventative actions
Standards for Compliance Monitoring
(are attached with the IEE reports)

• National Drinking Water Quality Standards (2062 B.S.)


• National Ambient Air Quality Standards for Nepal
• Recommended Noise Exposure Limits for the Work
Environment (adopted from Occupational Safety and
Health Administration (OSHA)
• Nepal Vehicle Mass Emission Standard, 2056 (1999)
• Recommended Standards for Vibration from Construction
Sites
• Tolerance Limits for Wastewater to be Discharged into
Inland Surface Waters from Combined Wastewater
Treatment Plant (Generic Standards)
