1. Reference: Police Blotter Entry No. BPS 2020-214

2. On October 27,2020 at about 10:00 PM, an alleged kidnapping incident

happened in Brgy. Bolbok Batangas City , wherein the victim was identified as
one Joejane Javier, 21 years old, single, student, and a resident of Brg. Sta. Rita
Karsada, same municipality.

3. Investigation conducted disclosed that while the victim were on her way home
with her mother and walking along the darkest part of the road , suddenly a
maroon van stopped at their front and the suspect came out. The said suspect
aggressively pushed the victim’s mother and grab the victim’s wrist and
quickly pulled inside the said van then fled. Suspect was identified wearing a
maong ripped pants, army green hoodie jacket and black mask. After the
incident, the suspects fled immediately toward unknown area of this
municipality direction riding maroon with unidentified plate number. There
was recovered piece of evidence at the crime scene .

4. Further investigation was conducted, resulted in the identification of one

witness. Interviews were conducted by this station with the members of the
family, victim’s colleagues, and barangay officials with regard to the
background of the victim. Based on the investigation conducted by this station,
the motive of the incident is still unknown. The witness was invited to this
station and executed his statement. Computerized facial composite of the
suspect will be illustrated based on the witness descriptions.

5. Continuous investigation is still conducted by this station to find leads

regarding to the said incident. Any information involved relative to same will
be immediately forwarded to that office as soon as obtained.

KIDNAPPING

MARIA MERCEDEZ JAVIER, 43 years old, married and a resident of Brgy. Sta Rita
Karsada, Batangas City personally appeared at this station and requested to put on record
that on or about 10:00 PM October 27, 2020 while she and her daughter JOEJANE JAVIER,
21 years old, single and living at the same address mentioned above were on their way
home, Mrs. Javier and her daughter were walking along the darkest part of the road and
suddenly a maroon van stopped at their front and a man came out from the said van. The
said man aggressively pushed Mrs. Javier then grab her daughter’s wrist and quickly pulled
inside the van and then fled. The said suspect were wearing maong ripped pants, army
green hoodie jacket and a black mask and the said van fled towards unknown area of the
municipality. The incident happened at Brgy. Bolbok Batangas, City.

FACTS OF THE CASE:

Investigation conducted showed that on or about 10:00 PM of 27 October 2020

along Brgy. Sta rita Karsada, Batangas city above named suspect, armed with evidence
no. “7”, with any provocation,with intent to chase and kidnapped the victim, suspect
forcibly taken the victim and put inside the vehicle .CONTRARY TO LAW. Accused
violated the Art. 267 and 268 of Revised Penal Code.This case will be presented to you
by SP02 Avegail Sanchez of Batangas city Police Station.

On the account of foregoing , the suspect was placed under arrest and the charges
of KIDDNAPPING AND SERIOUS ILLEGAL DETENTION against him will be brought
to the attention of an inquest Prosecutor for proper disposition and recommendation.

This is the complaint-affidavit of complainant, JOEJANE FLOR y JAVIER, Filipino, of legal age,
single and a resident of Sta. rita Karsada, Batangas City. The statements were taken and
recorded based on the examination made by Atty. Andrew Bonipasya, Notary Public for
Batangas, including the cities of Lipa, at the office of the same lawyer on November 6, 2020.

The complainant answered under oath in the Filipino language and had sworn that she

insidenting ito?
ANSWER 10: Opo, noong Ika-27 ng oktubre taong 2020 dakong alas 10 ng gabi, naglalakad
po ako kasama ng aking ina. May biglang tumigil at humarang na sasakyan sa aming harapan
pagbukas po ng pintuan isang lalaking nakajacket po ang lumabas ang ako po ay sapilitang
kinuha sa aking ina, dali dali po akong isinakay sa sasakyan at umalis, tinakpan po nila ang
aking bibig ng sa gayon akoy di makagawa ng ingay. Umiyak at pilit po kong sumisigaw pero
inuntog po ako ng lalaking kumuha sakin dahilan para mawalan ako ng malay.

QUESTION 11: Pagkatapos kang mawalan ng malay ano ang sumunod pang panyayari?
ANSWER 11: Nagising ako sa ingay ng dalwang taong nag uusap, nasa isa po akong silid at
mukhang abandonadong lugar. Nakatali ang aking kamay at paa mayroon ding nakaharang sa
aking bibig. Wala akong magawa kundi umiyak , patuloy na sumasakit ang aking ulo.

ANSWER 12: Sa ikalawang araw nagulat po ako ng may dalwang lalaki ang pumasok sa silid
na kinalalagyan ko, kinunan nila ako ng litrato at nung ako po ay pumapalag sa
pagkakahawag nila sakin , sinaktan po nila ako hinampas ng isang kahoy sa braso pati po sa
binti ,habang ako
po ay hinang hina sa pag iyak at pag palag kinukuhanan po nila ako ng litrato. Tatangalin
lamang po nila ang nakaharang saking bibig upang painumin ng tubig at pakainin ng kanin na
walang ulam. Dalwa o isang beses nila akong pinakakain sa isang buong araw.

ANSWER 13: Binabantayan po nila ako at binabantaang papatayin kapag gumawa ako ng

FINDINGS:

Above are the references for this requested examination and analysis of
fingerprint/identification by using some tools to examine the latent prints left by the
suspect and the real fingerprint record of the two men undergo in different types of
comparison and examination to be accurately reliable.

According to the investigation,the fingerprint coming from the vehicle and from this
suspect examined are both positive and confirmed the same result. Latent prints left
at the vehicle and the fingerprint identifications of the suspect have 100% MATCHED
in a DNA fingerprint examination.

8. On October 27,2020 at about 10:00 pm, an kidnapping incident transpired in

Brgy, Sta Rita Karsada Batangas, City wherein the victim was identified as one
Joe jane Javier,21 years old, single, student and resident of same place who
was kidnap by unidentified suspect.

9. Initial Investigation conducted that while the victim as going home with her
mother, were walking along the darkest part of the road and suddenly a car
appeared at their front. A man came out from the car and aggressively pushed
the mother to get the daughter. After getting the young lady, they immediately
fled and left the mother on the ground. The mother scream and call for help,
but before the public came, the car was already out of their sight with
undetermined direction. She was trembling out of fear and quickly went to the
nearest police station to report what happened. The day after the incident
happened, there was a message from an unknown number saying that they
were the kidnappers. The kidnappers ask for a big amount of money in
exchange of their alive daughter. They also sent a picture of the lady with
bruises on some parts of her body, hands and feet were tied, and her mouth
was covered to avoid noises. They want the negotiation to be private without
any notice and presence of the police but then, it was already reported to the
police so the officers came up with a plan. They will not post any missing
person and will do their investigation thoroughly.
10. On the fifth day, another message was received by the family of the victim from
the kidnappers saying that they will give enough time to earn the money in
return to their child. They also gave the place where they will negotiate. The
investigation team tried to have more information and by giving descriptions
from the witness, they picture out the vehicle that were used by the
kidnappers and also some information about the man who forcibly get the
lady. Through the help of that descriptions, the police investigation team found
out where the victim's at and also identified the suspects from kidnapping.
Victim was returned safe and a kidnappers was caught.

2. On October 27,2020 at about 10:00 pm, an kidnapping incident

transpired in Brgy, Sta Rita Karsada Batangas, City wherein the victim
was identified as one Joe jane Javier,21 years old, single, student and
resident of same place who was kidnapped by unidentified suspect.

3. Investigation conducted disclosed that while the victim were on her way
home with her mother and walking along the darkest part of the road ,
suddenly a maroon van stopped at their front and the suspect came out.
The suspect aggressively pushed the victim’s mother the grab the vuctim’s
wrist and quickly pulled inside the said van then fled. Suspect was
identified wearing a maong ripped pants, army green hoodie jacket and
black mask. After the incident, the suspects fled immediately toward
unknow area of this municipality direction riding maroon van without plate
number. There was no recovered piece of evidence at the crime scene .

4. Medico Legal examination conducted by PISNP Jake Rabida M.D that the
victim has punctured wound at the left side of her head, bruises at her wrist
and legs with sec of mental traumatic injury .

5. Finger print examination conducted by SPO2 MARK GIL ALMAREZ III he

examined the weapon used by the suspect and SPO2 MARK GIL ALMAREZ
found a finger print pattern on the blade of the knife POSITIVE MATCH to
the index finger of the suspect.
6. That, based on the aforesaid result, cases of violation of “KIDNAPPING
INCIDENT” which is defined and penalized under Art 267 of the
Revised Penal Code (RPC) of the Philippines were charged against
suspect Mr.
Marcos Irid y Mendezeval and Jacob Mendezeval y Solidad before the
office of the Provincial Prosecuter, Province of Batangas who after
inquisitorial investigation. Sentence of Kidnapping Incident is RECLUSION
TEMPORAL to death. Accused MARCOS IRIRD y MENDEZEVAL and
JACOB MENDEZEVAL y SOLIDAD are now detained at the Provincial Jail
of Batangas.
