CASE INESTIGATION PLAN: “MURDER OF AMADO NITOLLAMA JR. Y REYES

ALIAS BADONG CASE”

II. Situation

A. Background

Malice aforethought doesn't mean that a killer has to have acted out of spite or
hate. It exists if a defendant intends to kill someone without legal justification or excuse.
In addition, in most states, malice aforethought isn't limited to intentional killings. It can
also exist if the killer:

A. intentionally inflicts serious bodily harm that causes the victim's death, or

B. behaves in a way that shows extreme, reckless disregard for life and results in the
victim's death.

In today's society, murder is defined by statute, rather than common law.

According to Art. 248., Murder is any person who shall kill another person with evident
premeditation, treachery, superior strength, aid of armed men, consideration of prize
and reward of promise and by means of fire, poison, explosion and other means
involving great waste and ruin.

According to Tubigon MPS, that on March 19, 2016 at more or less 2:30AM in
Barangay Macaas, Tubigon, Bohol a shooting incident transpired victimizing Amado
Nitollama Jr., y Reyes alias Badong, 51 years old, married, resident of the said address
and speaker/announcer of the Liberal Party Candidates in the Municipality of Tubigon
during the campaign period of the 2016 Local Election.

Result of the investigation of Tubigon MPS That on the above time, date and place
of incident the above-named victim was shot to death while sleeping in his house beside
his wife Alicia Nitollama. Victim sustained lone gunshot wound on his left side of his
head (left parietal area) that caused his instantaneous death.

Further, investigation conducted wherein the wife of the victim averred that her
husband arrived home at around 1:00AM of March 19, 2016 after attending political
caucus of LP Mayoralty Candidate of Tubigon, William Jao at Brgy. Pinayagan Sur,
Tubigon, Bohol.
In addition, No pieces of evidence recovered at the crime scene but a deformed
slug believed to be from 9mm/.38 caliber firearm was recovered inside the victim’s head
when Dr. Brunia Medico Legal Officer of RCLO7 conducted autopsy of the cadaver.

IV. MISSION

A. Purpose

To enforce Art. 248 otherwise known as “Murder” and other relevant laws
punishable under this article in relation to the Murder Case of Amado Nitollama Jr. Y
Reyes Alias Badong.

B. Objectives

1. To effectively and efficiently manage the investigation focusing on the immediate

identify of the suspect for killing Amado Nitollama Jr. Y Reyes Alias Badong.

2. Determine their motive, locate and apprehend them and provide evidence of their guilt
and possible place them behind the bar of justice.

C. Target Personalities:

1. Alicia Nitollama, wife of the victim and

2. William Jao, LP Mayoralty Candidate of Tubigon

V. EXECUTION/ INVESTIGATION

The Tubigon MPS investigated the said murder case headed by CPL Gaylene
Sudayon as Supervisor and assisted by Sgt. Peter Reymund Sudayon as assistant
supervisor.

The investigators will use extra ordinary diligence and efforts in the investigation
of the case. They shall ensure that all the issues relevant to the case will ve properly
investigated. There will be a periodic or as the case may be rendering of reports and
continuous update of the investigation plan. The supervisor will keep a dated copy of
every revision of this plan.

This plan shall executed in three stages. The first stage is research and record
gathering of evidence; the second stage is the documentation and execution of
apprehension; the third stage is the evaluation/conclusion.

A. First stage: Research and record gathering

a. Verifications of identified suspect

b. Gathering of other criminal records of the identified suspects;

c. Examination of recoverd evidence

B. Second stage: Documentation and execution of apprehension

a. Conduct surveillance and take photograph on the activities of suspects

b. Get sworn statements/affidavits of complaints and witnesses;

c. Other matter to be determined later

C. Third stage: Evaluation/conclusion.

a. Seek legal assistance for the proper and stronger case to be filed against the
suspects

b. Filed appropriate charged if warranted

c. Other matter to be determined later

VI. Contingency

Upon investigation, if an investigation operation is not practical for a contingency

plan for the application of search warrant may arises as an option for the apprehension
of suspects and its cohorts.

VII. Administration and Logistics

A. TASKING AND PEOPLE

a. Shall be responsible in the overall supervision of the investigation and operation

b. Prepares the over-all plan of the CIPLAN

c. Take continuous responsibility for the success of this CIPLAN

a. Responsible in overall implementation of investigation and operations

b. Conduct all activities necessary of the accomplishment of the mission

4. Investigator

a. Assist the preparation of the spot, progress and after activity reports

1. This CIPLAN shall be treated and classified as “SECRET”

2. Use of codenames, call signs, passwords and countersigns shall be strictly

observed

3. All reports shall be made properly and treated accordingly.

E. COORDINATING INSTRUCTIONS

1. PNP Operational procedures and other operational issuance must be

observed at all times

2. Close coordination with the agencies is encouraged

3. Respect for human rights shall always be strictly observed

4. Keep the CIDG informed at all times

5. Submit all personnel who will compose the investigation teams.

VII. EFFECTIVITY

This CIPLAN shall take effect immediately upon approval.
