Rental Agreement - Mughal
This Rental Agreement (the “Agreement”) is made and entered into on this date
___________ by and between:
Mughal Empire Hotel and Apartments, a rental property and restaurant company
based in Dhobighat lalitpur duly represented by its manager Mr Rajesh Giri. (‘Lessor’)
AND
Whereas, the Lessor warrants that he/she possess absolute legal right on the property
described in Clause – 1 here under which he / she intends to allow the Lessee to possess
and use for resident purpose.
Whereas, the Lessee agrees to take and use the said premises as described in Clause – 1
on the terms and conditions mentioned in this Agreement.
1. LEASE PROPERTY
1.1 The Lessor agrees to rent out the __BHK Flat number ____ at Dhobighat,
Lalitpur, Nepal (hereinafter referred to as the ‘Property’) to the Lessee for
residence purpose.
1.2 Upon signing of this Agreement, the Lessee shall have uninterrupted access to
and possession of the Property and use for the purpose of their residence till the
continuance of this Agreement.
2. LEASE PERIOD
2.1 The terms of this Agreement shall be for a period of ___ months commencing
from ____________ for _____ Apartment unless terminated earlier to this
Agreement.
2.2 The lease period can be renewed by either party, provided that the other party
agrees to the same by giving notice of 1 month before the completion of the
lease period.
3. RENTAL FEES
3.1 The rent of the Flat ____ NPR ________ (in words Nepalese Rupee ______
Thousand Rupee only) per month shall be paid in 1 month’s advance. Rental
amount mentioned above is excluding VAT. For long term agreements, the
landlord will have the right to have a rent review after one year of the contract.
3.2 Lessee shall pay a security deposit equivalent to half month of rent i.e NPR
_______ (in words Nepalese Rupee ______ Thousand Rupee only.) to the Lessor,
which shall be refunded after the term of the agreement ends. The security
deposit shall remain with the Lessor till the term of the renewed period.
4. AMENITIES
5.1 The Lessee will not be allowed to rent out or sub-let the property.
6. MODIFICATION, UPKEEP, REPAIR AND MAINTENANCE
6.1 The Lessee shall not alter the physical structure of the property without the prior
permission of the Lessor.
6.2 Expenses for repairs and damages arising out of acts of nature shall be the
responsibility of Lessee.
7.1 For any outstanding charges on account of electricity, telephone, Internet and
satellite TV, before the commencement of this Agreement, Lessor hereby agrees
that he/she shall be responsible, and the Lessor shall ensure that all such
charges are cleared before handling over property to Lessee.
8.1 The Lessor will ensure that the Lessee will always have access to the property.
8.2 The Lessor will also ensure that he/she or his/her representative will be available
on phone or text to answer any queries to guide or advice regarding the
property.
9. TERMINATION
9.1 In case a party to this Agreement intends to vacate the property before the
expiry data of the original term or the renewed term, they can do so by serving
an advance notice in writing of at least 1 month to the other party. In the event a
party intends to vacate the property without serving this prior notice, she/he
shall pay a compensation equivalent to 1 month’s rent to the other party for its
unilateral termination of the Agreement without sufficient prior notice.
9.2 Upon termination of this Agreement for whatever reason, the Lessor shall return
the rent amount paid by Lessee that exceed the period of occupancy by the
Lessee.
10.1 In case of any disputes of differences arising out of or in connection with the
terms and conditions of this Agreement, such dispute or difference shall be settled
by amicable discussion. Failure to reach to an agreement, either party shall be free
to take legal recourse under the Contract Law of Nepal. Merely for reason of
initiation of dispute settlement process, the rights and responsibilities of the
respective parties shall not be deemed to cease or suspended, unless otherwise
agreed.
11. OTHERS
11.1 The Lessee shall not do, or allow doing, within the rented premises, the activities
that are prohibited by law of the country. Any such infringement of law is the sole
responsibility of the Lessee and could result in the immediate termination of the
Agreement and immediate vacation of the property.
11.2. This Agreement may be amended or modified by mutual consent and all such
amendments or modifications shall be kept in writing as a part and parcel of this
Agreement.
IN WITNESS WHEREOF, the parties have hereunto set their respective hand and seals on
the day of year mentioned at outset.
