MINUTES OF COUNCIL
A regular session of Troy City Council was held Monday, December 1, 2014, at 7:00p.m. in Council Chambers.
Members Present:

INVOCATION: An invocation was given by Council Member Phillips. The Pledge of Allegiance followed the
invocation.
MINUTES: The Clerk gave a summary of the minutes of the November 17, 2014, meeting of Troy City Council.
There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr.
Tremblay, to approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS:
Finance Committee: Mr. Kendall, Chairman, reported that Committee recommends that the 2015 Budget of the
City of Troy be approved by the preparation and adoption of the Appropriation Ordinance. He further
commented that regarding the funding of agencies for 2015, Committee recommends legislation be prepared to
continue to fund the Troy Development Council in the amount of $125,000, continue to fund Troy Main Street,
Inc. in the amount of $55,000, and to continue to fund the Troy Recreation Association, Inc. in the amount of
$29,000. Regarding the 2015 funding for the Public Television Communications Center {PTCC), he reported
that Committee recommends that legislation be prepared to fund PTCC in the amount of $12,500 for the first
quarter of 2015 with no further funding, and that Committee concurs with the staff recommendation that the City
purchase equipment to record Council and Committee meetings and to provide access to viewing those
meetings on the City's website.

CITIZEN COMMENTS:
David Murray, 104 N. Market Street (office address), commented that he is representing the PTCC Board of
Trustees. Mr. Murray thanked Council for the past generous support of PTCC, and advised that in addition to
filming/broadcasting Council and committee meetings, PTCC also provides programming for parades, non-profit
organizations/events, special events, sporting events, downtown events, and PTCC now provides live streaming
of Council meetings. He commented that reducing the funding to PTCC from $90,000 to $12,500 in two years
will put them in the position of not being able to continue, and asked that the 2015 funding be reconsidered.

COMMENTS OF COUNCIL:
-In response to Mr. Clark, Mr. Titterington advised that the third and final round of leaf collection will continue
until the third round collections have been made in all areas. Mr. Clark also noted that the Silver Sticks Hockey
Tournament will return to the Hobart Arena December 13-14.

AUDIENCE COMMENTS:
-Marty Hobart, 101 Kings Chapel Drive, representing the Troy Historical Alliance, commented that the seven
local organizations that make up the Troy Historical Alliance, are committed "to better serve all things historic in
the city of Troy." In that regard, he thanked ITW for being willing to preserve the stones that were part of Lock
12 of the Miami Erie Canal from being totally destroyed with the demolition of the former ITW/Hobart Brothers
site on West Main Street, and recognized the cost and effort involved in that preservation. Mr. Hobart
commented that it is the hope of the Alliance that if the stone lock remnants are given to the City that they can
be incorporated into a landmark(s) and the Alliance members would be willing to participate in discussions and
development plans for their use.
-As the President of the Troy Recreation Board, Mr. Hobart mentioned the many events coming up at the Hobart
Arena.
COMMENTS RELATED TO ITW SITE AND/OR THE LOCK 12 STONES:
-Mrs. Baker suggested that the City work with Mr. Hobart and other representatives of the Troy Historical
Alliance regarding use of the canal lock stones.
-Mr. Phillips asked that if the stones are given to the City, if any unused stones could be sold or given to other
historic organizations. Mr. Titterington stated that could be looked into. He also commented that meetings
have already been held with some members of the Alliance, it is hoped some stones could be incorporated into
the redevelopment of the ITW/Hobart site, and at this time there is no urgency to move the stones from the
temporary storage site.
-Mrs. Oda commented that people want to tour the ITW site when it cleaned up to see old lock site, Mr.
Titterington advised that there will not be an old lock site to be viewed, the land will be filled in and will be green
space, and the land is private property owned by ITW.
-In response to a question of Mrs. Baker regarding the time frame to clear the ITW site of the remaining
demolition rubble, Mr. Titterington commented that he understands the tentative schedule is to finish the work by
January, weather permitting.
-Mr. Clark suggested the plans to reuse the stones be shared with Council for possible brainstorming.

READING AND SIGNING OF NOTICE OF SPECIAL MEETING. The Notice of Special meeting for Monday the
8th day of December, 2014 at 6:00 P.M. or later if the Meeting of the Finance Committee scheduled for 5:30
P.M, Dec. 8, 2014, has not concluded by 6:00P.M. for the purpose of considering: R-59-2014 (2015 funding to
PTCC), and 0-36-2014 (Appropriation for 2015). This meeting is called by Council Members Thomas M. Kendall,
John W. Schweser, and Douglas W. Tremblay pursuant to Rule XXV of the Troy City Council Rules for Procedure
was read. The notice was signed by all members of Council. (Notice attached to original minutes.)
COMMITTEE REPORTS:
Finance Committee: Mr. Kendall, Chairman, gave an oral report that Committee met on December 8, 2014 at
5:30 pm to again discuss the funding recommendation for 2015 in the amount of $12,500 to the Public
Television Communications Center (PTCC) with the City thereafter purchasing equipment to record Council and
Committee meetings and to provide access to viewing those meetings on the City's website.
Mr. Kendall
reported that after considering the information provided by PTCC and the draft 10-year technology needs of the
City, it is the unanimous recommendation of the Finance Committee that the $12,500 funding to PTCC be
approved as previously recommended by the Committee.
CITIZEN COMMENTS:
David Murray, 104 N. Market Street (office address), commented that he is representing the PTCC Board of
Trustees. Regarding the discussion at the Finance Committee meeting, he wanted to clarify some comments:
live streaming on the internet means showing what is already on TV and PTCC would not broadcast a meeting
live without the consent of Council; regarding a merger with Piqua, Piqua was only interested in access to Troy's
revenues and lost interest after the City reduced the funding to PTCC; TV5 is one of several channels not
carried by Time Warner as a basic plan option, but he feels this is Time Warner's way to force people to pay for
a higher tier plan to get those channel(s); and PTCC has updated some equipment but has not been able to
update programming due to reduced City funding.

o Finsbury, Riverside and Race Waterline - Race Street waterline and
restoration is complete. Finsbury waterline is 70o/o installed with
boring commencing next.
o Sewer Lining Project - Contractors are lining SW Interceptor around
West Market and Arthur, Southview and northeast of the river.
Recreation Director Ken Siler reports that approximately 500 people attended
and enjoyed the outstanding December 7 Hometown Holiday Concert with
the Dayton Philharmonic. At this time, the Dayton Philharmonic
Organization is considering bringing a similar concert back to the Hobart
Arena next year.
The third round of the 2014 leaf pick-up began on December 8 and staff is
still working on the completion of this round. Anyone still wanting to dispose
of leaves after the completion of the third round will have to place the leaves
in T-bags for collection.
City Offices will be closed on Thursday and Friday, December 25 and 26,
2014 for the Christmas Holiday. Trash collection will be delayed one day
beginning Thursday, December 25. City Offices will also be closed January
1, 2015 for the New Year's Holiday. Trash collection will be delayed one day
beginning Thursday, January 1. Recycling will follow the same schedule as
regular trash pick-up.
After the hustle and bustle of the holiday season, and citizens are putting
Christmas decorations away and wanting to get their homes back to normal,
live Christmas trees can be placed at the curb for the Street Division to pick
up and dispose of from December 29, 2014 through January 30, 2015. This
service is provided in cooperation with the Miami County Transfer Station
and recycling center.

Upgraded water services in East Dakota Street, Madison Street, South Crawford
Street, South Mulberry Street, South Oxford Street, and Grant Street.
Replaced broken water valves on Clay Street, Simpson Street, Franklin Street,
Canal Street, Race Street, and Pennsylvania Avenue.
Cleaned and televised paving list streets including: Grant Street, Garfield Street,
Wheeler Street, Pennsylvania Avenue.
Repaired a catch basin at Fire Station #3.
Installed a new catch basin at South Clay Street and East Simpson Street.

PROJECT
This phase of the project is between the Adams Street Bridge and Staunton Road. Project
has been awarded to LJ DeWeese and construction is underway. Underground utility work
is complete. Contractor is working on the wall adjacent to Community Park.
Renovation is complete. The parking kiosk has been ordered is scheduled to arrive in
January 2015. The concrete pad for the kiosk has been installed.
ODOT has funded a portion of this project. Design updates will be made by Poggemeyer
Design Group. Initial survey work is complete. ODOT has completed the environmental
Downtown Streetscape Phase 3B
documentation. Design has been submitted to ODOT for their approval prior to proceeding
with construction.
Staff has been working with an oustide contractor to make the Engineering Electronic Files
organized in such a way that all staff can have access to most documents. This will improve
Engineering Electronic File Reorganization
effeciency with document filing and is expected to reduce the volume of space necessary to
keep the electronic files.
Council approved the recommendation to enter into an agreement with MSA Architects for
Hobart Arena Renovation
the design of this work. The agreement is being finalized.
City Council authorized bidding at $75,000. The lighthouse has been ordered and we are
Lighthouse at Treasure Island
awaiting the delivery schedule. Base construction is underway. No date for delivery of the
lighthouse has been established.
This phase includes work from Monroe Street to the RR tracks. Council approved the
McKaig Road Phase 2
recommendation to enter into an agreement with LJB, Inc. for the design of this project. The
agreement is being finalized.
City Council authorized bidding this project. The bid opening was held on November 26.
Marina Boathouse Renovation
Staff will be meeting with the apparent low bidder for clarification of bid.
The City has received a grant from The Troy Foundation to pay for design of a Mountain
Bike Trail on land owned by the City. A purchase order was issued to the International
Mountain Bike Trail
Mountain Biking Association (I MBA) to design the project. The consultant has been to Troy
to review possible sites. lr}fgrmation from the consultant is pending.

ODOT Paving
OPWC
Staff is working with ODOT regarding the paving along SR 55 on the west side of town as
well as the traffic circle. ODOT has issued the Final Legislation which City Council passed
and our payment has been made.
Staff will be submitting pre-applications for the three year pipeline of projects that we
propose to be funded with this program. The projects are: McKaig Road Phase Ill, N.
Market Phase II, and McKaig Road Phase IV. The pre-application for McKaig Road Phase
Ill has obtained enough points to be considered for funding. Council authorized the final
application for the McKaig Road Phase Ill project.
Piqua-Troy/Troy-Urbana Intersection
Bids were opened and the project awarded to Double Jay Construction. Curb has been
installed and the project is moving along well. Base paving is complete and the street has
reopened. Reconstruction of Troy-Urbana will be completed in the Spring of 2015.
Water Regionalization
Council has authorized a contract with RA Consultants. Staff has submitted all requested
information for evaluation. Workshop #2 was held and the project will continue.
Water Tower
Sidewalk Program 8
Sidewalk, Sewer, and Sump Inspections
Council authorized an agreement for the design of a new Extra High Service Water Tower
with the firm of EMH&T. The agreement is now being finalized.
Council authorized the bidding of $2.8 M of sewer work. Contract has been awarded to
Layne lnliners and Miller Pipeline. We will be notifying property owners as necessary for this
project. Layne lnliners began work in early November. Miller Pipeline is lining in Southview
and NE of River; Layne lnliner is working under 1-75 toW. Market Street & Arthur Drive
intersection.
Council authorized bidding for the Phase 8 sidewalks where the property owner did not take
out a permit to do the work. Project was awarded to I. F. Weber. Work is underway.
Inspections are continuing to be completed when requested .
Staff has started working with Miami Valley Lighting (MVL) and MVCC to determine the best
way to convert the City's Mercury Vapor (MV) street lights to High Pressure Sodium (HPS)
street lights required by law. As a trial, LED street lights have been installed on Plum Street,
Short Street, Adams Street, and along Shaftsbury Road at Adams Street.

restoration. Finsbury clearing and waterline is complete except for west piece which ties it

into Shaftsbury. Governor's to Troy-Sidney waterline is awaiting CSX approval.
OTHER PROJECTS
Based on the application submitted February 19, Troy was again named as an Honorable
Mention Community by the League of American Bicyclists. While we were hoping for better
recognition, this is a great accomplishment.
A draft of the revision has been submitted to the Service Director's Office.
This outdoor work continues as time and weather permit.

I have attached two reports which summarize concerns that are being
addressed by the Planning Division from November 24, 2014 to December
10, 2014. The first report shows all permits that were issued by the Planning
Division. The report contains the address and type of permit and separates
the information by each ward. There were 20 permits issued during this
time period.
The second report contains the address, type of concern, and a summary of
the current status of on-going issues. Both open and closed concerns are
listed and are separated by each ward.
As in the past, all costs associated with the removal of trash and elimination
of noxious weeds will be invoiced to the property owner. If the property
owner does not pay the invoice, the cost will be assessed to the property
taxes.
