MINUTES OF COUNCIL
A regular session of Troy City Council was held Monday, December 1, 2014, at 7:00p.m. in Council Chambers.
Members Present:

Clark, Heath, Kendall, Oda, Phillips, Schweser, Snee, Tremblay and Twiss.

INVOCATION: An invocation was given by Council Member Phillips. The Pledge of Allegiance followed the
invocation.

MINUTES: The Clerk gave a summary of the minutes of the November 17, 2014, meeting of Troy City Council.
There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr.
Tremblay, to approve these minutes. Motion passed by unanimous roll call vote.

COMMITTEE REPORTS:
Finance Committee: Mr. Kendall, Chairman, reported that Committee recommends that the 2015 Budget of the
City of Troy be approved by the preparation and adoption of the Appropriation Ordinance. He further
commented that regarding the funding of agencies for 2015, Committee recommends legislation be prepared to
continue to fund the Troy Development Council in the amount of $125,000, continue to fund Troy Main Street,
Inc. in the amount of $55,000, and to continue to fund the Troy Recreation Association, Inc. in the amount of
$29,000. Regarding the 2015 funding for the Public Television Communications Center {PTCC), he reported
that Committee recommends that legislation be prepared to fund PTCC in the amount of $12,500 for the first
quarter of 2015 with no further funding, and that Committee concurs with the staff recommendation that the City
purchase equipment to record Council and Committee meetings and to provide access to viewing those
meetings on the City's website.

CITIZEN COMMENTS:
David Murray, 104 N. Market Street (office address), commented that he is representing the PTCC Board of
Trustees. Mr. Murray thanked Council for the past generous support of PTCC, and advised that in addition to
filming/broadcasting Council and committee meetings, PTCC also provides programming for parades, non-profit
organizations/events, special events, sporting events, downtown events, and PTCC now provides live streaming
of Council meetings. He commented that reducing the funding to PTCC from $90,000 to $12,500 in two years
will put them in the position of not being able to continue, and asked that the 2015 funding be reconsidered.

COMMENTS OF THE MAYOR: Mayor Beamish commented as follows:


-The first November 27 Pilgrims Pedal bike ride had a number of participants.
-He appreciated Council participating in the November 28 illumination parade and Christmas tree lighting.
-On November 29, the Pop Rocks Jump Rope Team gave an advance performance of their new program.

COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY:
follows:
-Third round of leaf collection is scheduled to start December 8.
-City offices will be closed December 25-26 for the Christmas Holiday and January 1 for the New Year's
Holiday. Refuse collection will be delayed one day starting December 25 and January 1.
-North Market StreeUPiqua-Troy Road/Troy-Urbana Road Intersection Realignment Project remains on
schedule and may be done by December 12. A temporary course of asphalt will be placed for the winter, with a
final course placed next spring.
-Waterline project on Barnhart just north of SR 55/and waterlines on Oak, Frank and Scott Streets, is to be
completed later this week, weather permitted, and will have a temporary course of asphalt placed for the winter,
with a final course placed next spring.

COMMENTS OF PRESIDENT OF COUNCIL: Mrs. Baker commented as follows:


-Asked if the Fire Department was operating out of Station #2 (North Market Street), and Mr. Titterington
advised that it was, that a "brown out" of that station was for only two days to allow for curb work related to the
North Market StreeUPiqua-Troy Road/Troy-Urbana Road Intersection Realignment Project.
-Mrs. Baker asked if information related to the Riverfront Development Project could be added to the website.
Mr. Titterington commented that such information will be made more prominent.

COMMENTS OF COUNCIL:
-In response to Mr. Clark, Mr. Titterington advised that the third and final round of leaf collection will continue
until the third round collections have been made in all areas. Mr. Clark also noted that the Silver Sticks Hockey
Tournament will return to the Hobart Arena December 13-14.

AUDIENCE COMMENTS:
-Marty Hobart, 101 Kings Chapel Drive, representing the Troy Historical Alliance, commented that the seven
local organizations that make up the Troy Historical Alliance, are committed "to better serve all things historic in
the city of Troy." In that regard, he thanked ITW for being willing to preserve the stones that were part of Lock
12 of the Miami Erie Canal from being totally destroyed with the demolition of the former ITW/Hobart Brothers
site on West Main Street, and recognized the cost and effort involved in that preservation. Mr. Hobart
commented that it is the hope of the Alliance that if the stone lock remnants are given to the City that they can
be incorporated into a landmark(s) and the Alliance members would be willing to participate in discussions and
development plans for their use.
-As the President of the Troy Recreation Board, Mr. Hobart mentioned the many events coming up at the Hobart
Arena.
COMMENTS RELATED TO ITW SITE AND/OR THE LOCK 12 STONES:
-Mrs. Baker suggested that the City work with Mr. Hobart and other representatives of the Troy Historical
Alliance regarding use of the canal lock stones.
-Mr. Phillips asked that if the stones are given to the City, if any unused stones could be sold or given to other
historic organizations. Mr. Titterington stated that could be looked into. He also commented that meetings
have already been held with some members of the Alliance, it is hoped some stones could be incorporated into
the redevelopment of the ITW/Hobart site, and at this time there is no urgency to move the stones from the
temporary storage site.
-Mrs. Oda commented that people want to tour the ITW site when it cleaned up to see old lock site, Mr.
Titterington advised that there will not be an old lock site to be viewed, the land will be filled in and will be green
space, and the land is private property owned by ITW.
-In response to a question of Mrs. Baker regarding the time frame to clear the ITW site of the remaining
demolition rubble, Mr. Titterington commented that he understands the tentative schedule is to finish the work by
January, weather permitting.
-Mr. Clark suggested the plans to reuse the stones be shared with Council for possible brainstorming.

READING AND SIGNING OF NOTICE OF SPECIAL MEETING. The Notice of Special meeting for Monday the
8th day of December, 2014 at 6:00 P.M. or later if the Meeting of the Finance Committee scheduled for 5:30
P.M, Dec. 8, 2014, has not concluded by 6:00P.M. for the purpose of considering: R-59-2014 (2015 funding to
PTCC), and 0-36-2014 (Appropriation for 2015). This meeting is called by Council Members Thomas M. Kendall,
John W. Schweser, and Douglas W. Tremblay pursuant to Rule XXV of the Troy City Council Rules for Procedure
was read. The notice was signed by all members of Council. (Notice attached to original minutes.)

COMMITTEE REPORTS:
Finance Committee: Mr. Kendall, Chairman, gave an oral report that Committee met on December 8, 2014 at
5:30 pm to again discuss the funding recommendation for 2015 in the amount of $12,500 to the Public
Television Communications Center (PTCC) with the City thereafter purchasing equipment to record Council and
Committee meetings and to provide access to viewing those meetings on the City's website.
Mr. Kendall
reported that after considering the information provided by PTCC and the draft 10-year technology needs of the
City, it is the unanimous recommendation of the Finance Committee that the $12,500 funding to PTCC be
approved as previously recommended by the Committee.

CITIZEN COMMENTS:
David Murray, 104 N. Market Street (office address), commented that he is representing the PTCC Board of
Trustees. Regarding the discussion at the Finance Committee meeting, he wanted to clarify some comments:
live streaming on the internet means showing what is already on TV and PTCC would not broadcast a meeting
live without the consent of Council; regarding a merger with Piqua, Piqua was only interested in access to Troy's
revenues and lost interest after the City reduced the funding to PTCC; TV5 is one of several channels not
carried by Time Warner as a basic plan option, but he feels this is Time Warner's way to force people to pay for
a higher tier plan to get those channel(s); and PTCC has updated some equipment but has not been able to
update programming due to reduced City funding.

-Mr. Clark stated his opinion that a budget could be adopted if the Treasure Island piece was removed.

Improvement from the budget, which would be the $1,723,000 expenditure and related debt service.

TREASURE ISLAND PARK PORTION OF THE

WHEREAS, Council previously approved a reappropriation that included funds


for the construction of the Treasure Island Park portion of the Riverfront Development
Project; and
WHEREAS, the construction of the Treasure Island Park project has been
recommended by the Board of Park Commissioners;
WHEREAS, the City has been awarded a grant from the State of Ohio in the
amount of One Hundred Fifty Thousand Dollars and no/100 ($150,000.00) that is
applicable to the parking lots at Treasure Island Park, and the construction of the
parking lots will be included in this authorization for bidding.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Troy, as
follows:
SECTION 1:

That the Director of Public Service and Safety of the City of Troy,

Ohio is hereby authorized to advertise for bids and enter into a contract for the
construction of Treasure Island Park portion of the Riverfront Development Project, in
accordance with the plans and specifications now on file in the Office of the Director of
Public Service and Safety, at a cost not to exceed One Million, Eight Hundred SeventyThree Thousand Dollars and no/1 00 ($1 ,873,000.00).

The following bid openings were held on, November 26:


o The Boathouse and Marina Renovation received 4 bids ranging from
$924,000 to $1,403,000.
These amounts are without alternates.
Council approved $1,000,000 for this project. Staff is reviewing the
bids.
o Fire Hydrants received 2 bids in the amounts of $79,779.79 and
$89,631.20. Council approved $105,600 for this purchase. Staff is
reviewing the bids.
The following contracts have been awarded:
o Bituminous Materials was awarded to Valley Asphalt Corp. of
Springfield, Ohio, the only bid received, in the amount of $57,800.
Council approved $59,500 for this purchase.
o Water Meters was awarded to Everett J. Prescott, Inc. of West
Carrollton, Ohio, the only bid received, in the amount of $124,657.80 .
Council approved $178,500 for this purchase.
Major Project Update:
o Sidewalk Program 8 - work is underway and should be complete before
the end of the year.
o Kent Lane -waterline and restoration is complete.
o North Market Street/Piqua-Troy /Troy-Urbana Intersection Realignment
- intersection has been reopened for winter; please be careful when
traversing the intersection. The project will be completed in the spring.
o Barnhart Road, Arthur Road, Oak Street, Scott Street & Frank Street
Waterlines - Scott Street, Frank Street and Oak Street waterline and
street restoration is complete.
o Adams Street Phase 2 - underground concrete and base asphalt work
is complete. Contractor will continue working on the park wall.

o Finsbury, Riverside and Race Waterline - Race Street waterline and
restoration is complete. Finsbury waterline is 70o/o installed with
boring commencing next.
o Sewer Lining Project - Contractors are lining SW Interceptor around
West Market and Arthur, Southview and northeast of the river.

Recreation Director Ken Siler reports that approximately 500 people attended
and enjoyed the outstanding December 7 Hometown Holiday Concert with
the Dayton Philharmonic. At this time, the Dayton Philharmonic
Organization is considering bringing a similar concert back to the Hobart
Arena next year.

The third round of the 2014 leaf pick-up began on December 8 and staff is
still working on the completion of this round. Anyone still wanting to dispose
of leaves after the completion of the third round will have to place the leaves
in T-bags for collection.

City Offices will be closed on Thursday and Friday, December 25 and 26,
2014 for the Christmas Holiday. Trash collection will be delayed one day
beginning Thursday, December 25. City Offices will also be closed January
1, 2015 for the New Year's Holiday. Trash collection will be delayed one day
beginning Thursday, January 1. Recycling will follow the same schedule as
regular trash pick-up.

After the hustle and bustle of the holiday season, and citizens are putting
Christmas decorations away and wanting to get their homes back to normal,
live Christmas trees can be placed at the curb for the Street Division to pick
up and dispose of from December 29, 2014 through January 30, 2015. This
service is provided in cooperation with the Miami County Transfer Station
and recycling center.

Street- Including Solid Waste- Jerry Mullins, Foreman


Collected and transported 265 tons of residential trash since the last report of
226 tons.
Used 790 tons of asphalt. The asphalt plant has closed for the season. Any
repairs between now and May 20 15 will have to be made with cold patch to be
repaired permanently in the spring of 2015.
Delivered recycling bins as requested.
Collected yard waste bags and bundled brush.
Picked up leaves from the downtown area. Completed Round 2 and began
Round 3 of the leaf collection schedule. The new pull behind leaf vacuum truck
has been placed into operation. This one operator system can collect the same
amount of leaves in an eight hour period as our truck crews. We are expecting
delivery of the retro-fitted sweeper later this month. It will be placed into
operation next season.
If residents place brush out during leaf season, it will still need to be bundled or
placed in yard waste bags in order for it to be collected.
Worked on the calibration of our salt spreaders in an effort to make the salting
process more efficient
All of the brine trucks are loaded and ready for any upcoming snow events. We
also have 7,500 gallons of brine pre-made and ready for distribution.

Completed Ohio Utilities Protection Service requests as needed.
Repaired a street light in Troy Community Park.
Repaired a security light and several exit lights at Riverside Cemetery.
Repaired a gas heater and installed a new gas valve at Fire Station #3.
Repaired nine quartz heaters and installed a new GFCI outlet at Fire Station # 1.
Replaced a "No Turn On Red" sign at the South Market and West Market intersection.
Repaired an electrical outlet on a pole at the corner of North Market Street and Water
Street.
Repaired several lights at City Hall.
Continued to repair the downtown Christmas decorations.
Water Distribution/Sewer Maintenance- Tom Parsons, Foreman
Marked numerous Ohio Utilities Protection Service tickets.
Investigated numerous high consumption alerts.
Completed a number of work orders for Billing and Collection.
Shut-off non-payment customers and reconnected as payments were made.

Upgraded water services in East Dakota Street, Madison Street, South Crawford
Street, South Mulberry Street, South Oxford Street, and Grant Street.
Replaced broken water valves on Clay Street, Simpson Street, Franklin Street,
Canal Street, Race Street, and Pennsylvania Avenue.
Cleaned and televised paving list streets including: Grant Street, Garfield Street,
Wheeler Street, Pennsylvania Avenue.
Repaired a catch basin at Fire Station #3.
Installed a new catch basin at South Clay Street and East Simpson Street.

Water Treatment Plant -Jeff Monee


For the period of November 2014, the WTP pumped a total of 102.619 million
gallons (MG) to our distribution system and customers in West Milton and parts
of Miami County (avg. 3.421 MG/day). Total precipitation recorded at the WTP
for October was 1.73". Respective totals for November in previous
years are:

The newly completed VOC Air Stripping Facility has been in continuous
operation since November 25. Initial independent lab results show complete
removal of all trace volatile organic compounds from well 12W. Installation of
perimeter fencing to secure the tower and blower areas began on December 9.
6 bulk water account holders withdrew a total of 4 7, 100 gallons during the
month of November, total revenue was $ 401.4 7.
A total of 9,068,582 gallons were pumped to the Extra High Service pressure
zone during the month of November, for an average daily consumption of .2925
MG.
Repairs and upgrades to high service 1 distribution pump have been completed,
and this pump was reinstalled on December 9 by staff. A refurbished bowl
assembly along with new shafting and column piping will return this 16 year-old
pump to original performance levels. The 100 hp. motor was rewound to inverter
duty standards to make it compatible with a power-saving VFD drive that will be
added later this month.
Repairs and upgrades to production well 13 are nearly complete. This well,
drilled in 1989, will receive a new submersible pump and 40 hp. motor. A
leaking check valve assembly will be replaced, and 50' of cost-saving flexible drop
pipe will be installed to replace deteriorated steel column piping.
Staff completed installation of an auxiliary heating unit at the Air Stripper
Pumphouse.
Contractor has completed removal of 1,500 dry tons of softening residuals from
the West Lagoon in accordance with the Agreement signed with the City of
Dayton.
Installation of SCADA equipment at the Staunton Road Lift Station has been
completed. Remote monitoring of this station will begin after radio signal
strength adjustments are made.
Operations Technician Ralph Walters attended the FEMA Disaster Management
for Water Utilities course earlier this month, and also attended a Safe Drinking
Water Act Update Seminar with Plant Mechanic Steve Welker.

Wastewater Treatment Plant - Tim Snider


Staff re-built the raw sludge recirculation pump.
Staff replaced a faulty level sensor at Heywood pump station.
Staff re-attached an aluminum slide gate stem bracket at Staunton Road
storm water pump station.
Completed annual performance evaluation for exempt employees.
Staff worked on re-habbing the U.V. modules for the 2015 disinfection
season.
Maintenance staff completed the required preventive maintenance work
orders.

PROJECT

Adams Street Phase 2

ACTIVE PROJECTS STATUS

This phase of the project is between the Adams Street Bridge and Staunton Road. Project
has been awarded to LJ DeWeese and construction is underway. Underground utility work
is complete. Contractor is working on the wall adjacent to Community Park.

Renovation is complete. The parking kiosk has been ordered is scheduled to arrive in
January 2015. The concrete pad for the kiosk has been installed.
ODOT has funded a portion of this project. Design updates will be made by Poggemeyer
Design Group. Initial survey work is complete. ODOT has completed the environmental
Downtown Streetscape Phase 3B
documentation. Design has been submitted to ODOT for their approval prior to proceeding
with construction.
Staff has been working with an oustide contractor to make the Engineering Electronic Files
organized in such a way that all staff can have access to most documents. This will improve

effeciency with document filing and is expected to reduce the volume of space necessary to
keep the electronic files.
Council approved the recommendation to enter into an agreement with MSA Architects for
Hobart Arena Renovation
the design of this work. The agreement is being finalized.
City Council authorized bidding at $75,000. The lighthouse has been ordered and we are

awaiting the delivery schedule. Base construction is underway. No date for delivery of the
lighthouse has been established.
This phase includes work from Monroe Street to the RR tracks. Council approved the
McKaig Road Phase 2
recommendation to enter into an agreement with LJB, Inc. for the design of this project. The
agreement is being finalized.
City Council authorized bidding this project. The bid opening was held on November 26.
Marina Boathouse Renovation
Staff will be meeting with the apparent low bidder for clarification of bid.
The City has received a grant from The Troy Foundation to pay for design of a Mountain
Bike Trail on land owned by the City. A purchase order was issued to the International
Mountain Bike Trail
Mountain Biking Association (I MBA) to design the project. The consultant has been to Troy
to review possible sites. lr}fgrmation from the consultant is pending.

ODOT Paving

OPWC

Staff is working with ODOT regarding the paving along SR 55 on the west side of town as
well as the traffic circle. ODOT has issued the Final Legislation which City Council passed
and our payment has been made.
Staff will be submitting pre-applications for the three year pipeline of projects that we
propose to be funded with this program. The projects are: McKaig Road Phase Ill, N.
Market Phase II, and McKaig Road Phase IV. The pre-application for McKaig Road Phase
Ill has obtained enough points to be considered for funding. Council authorized the final
application for the McKaig Road Phase Ill project.

Piqua-Troy/Troy-Urbana Intersection

Bids were opened and the project awarded to Double Jay Construction. Curb has been
installed and the project is moving along well. Base paving is complete and the street has
reopened. Reconstruction of Troy-Urbana will be completed in the Spring of 2015.

Water Regionalization

Council has authorized a contract with RA Consultants. Staff has submitted all requested
information for evaluation. Workshop #2 was held and the project will continue.

Street Light Conversion

Council authorized an agreement for the design of a new Extra High Service Water Tower
with the firm of EMH&T. The agreement is now being finalized.
Council authorized the bidding of $2.8 M of sewer work. Contract has been awarded to
Layne lnliners and Miller Pipeline. We will be notifying property owners as necessary for this
project. Layne lnliners began work in early November. Miller Pipeline is lining in Southview
and NE of River; Layne lnliner is working under 1-75 toW. Market Street & Arthur Drive
intersection.
Council authorized bidding for the Phase 8 sidewalks where the property owner did not take
out a permit to do the work. Project was awarded to I. F. Weber. Work is underway.
Inspections are continuing to be completed when requested .
Staff has started working with Miami Valley Lighting (MVL) and MVCC to determine the best
way to convert the City's Mercury Vapor (MV) street lights to High Pressure Sodium (HPS)
street lights required by law. As a trial, LED street lights have been installed on Plum Street,
Short Street, Adams Street, and along Shaftsbury Road at Adams Street.

Prelimininary design is complete. A recommendation has been forwarded to Council to


authorize bidding the Park construction in an amount not to exceed $1,873,000.
Restoration work is complete.
Contract has been awarded to Sturm Construction. Work on Scott, Frank, and Oak Streets
is underway. Testing is underway on this segment of the project and once the testing is
completed, service lines are completed. Restoration is complete along Scott, Frank & Oak
Streets. The Barnhart/SR 718 section will begin in the next month.

Contract has been awarded to Finfrock Construction. Work at Race is complete including
Water Project #4 - Finsbury, Govenors, &
restoration. Finsbury clearing and waterline is complete except for west piece which ties it
Race
into Shaftsbury. Governor's to Troy-Sidney waterline is awaiting CSX approval.

Based on the application submitted February 19, Troy was again named as an Honorable
Mention Community by the League of American Bicyclists. While we were hoping for better
recognition, this is a great accomplishment.
A draft of the revision has been submitted to the Service Director's Office.
This outdoor work continues as time and weather permit.

I have attached two reports which summarize concerns that are being
addressed by the Planning Division from November 24, 2014 to December
10, 2014. The first report shows all permits that were issued by the Planning
Division. The report contains the address and type of permit and separates
the information by each ward. There were 20 permits issued during this
time period.
The second report contains the address, type of concern, and a summary of
the current status of on-going issues. Both open and closed concerns are
listed and are separated by each ward.
As in the past, all costs associated with the removal of trash and elimination
of noxious weeds will be invoiced to the property owner. If the property
owner does not pay the invoice, the cost will be assessed to the property
taxes.

complain about a sign on the east exterior wall of this
property. Upon inspection I found a 5 1 x9 1 ( 4 5 sq ft) temp. free
speech banner. I looked at previous issues and found a name and
# for a contact, Dave @ 937-726-7299, I called and spoke with
Dave. I explained that this sign can only be a max of 24 sq ft
and placed at least 5 1 from adjoining property lines which means
he will have to make this sign smaller and move it to a new
location, follow up as needed.
12-9-14 dp Received correspondence from Jim Livingston, Law
Director, and he agrees this is a free speech sign. It does not
need a permit, it does not need to go before Planning Comm. but
it is limited to size and placement according to what district

PO Officer Short noticed this Hobie Cat parked along the rear of
this property. Upon investigation it was discovered the tags on

owner, and explained to him the situation. He is going to
attempt to get in touch with the owner of this boat and trailer.
In the mean time the boat and trailer have been moved to the
private property parking lot at this location. I advised Bob
Cole I would be sending the violsation letter Certified. Follow
